95.2% Opposed to California DMV Plan to Tax by the Mile

Alex has been reporting on the national plan to put satellite trackers in all or cars or transponders in all cars for seven years. The Federal plan has been public that long.

Now, Oregon, California and New York are moving forward with it. The Feds' own documents say you will be taxed over 25 cents a mile. Here in Austin, Texas where infowars.com is based, the City has announced the transponder system and admits that is will cost the average driver, on top of all other taxes, $1,800 a year to start.

We've seen national polls where upwards of 98 percent of respondents are against taxation by the mile, especially when it's connected to a tracking system.

Look at the non-scientific poll done by a local TV station in California where 95 percent are against it. But, of course, Schwarzenegger doesn't care. He's for it.

Gov. Arnold Schwarzenegger on Monday appointed a new Department of Motor Vehicles director who has advocated taxing motorists for every mile they drive — by placing tracking devices in their cars.

The idea would mean a significant overhaul of how California collects taxes to maintain its often-crumbling roads. Under the plan, the state gas tax — now 18 cents a gallon — would be replaced with a tax on every mile traveled by each car and truck.
The notion has not been endorsed by Schwarzenegger but is gaining acceptance among transportation and budget experts. As Californians drive increasingly more fuel-efficient cars, state officials are alarmed that the gasoline tax will not raise enough money to keep up with road needs.

Charging people for the miles they drive also worries some owners of hybrid cars, because it could wipe out any gas-tax savings they now enjoy.

Dan Beal, managing director of public policy for the Automobile Club of Southern California, said altering the system would remove one incentive to buying new-technology hybrid cars like the Toyota Prius, because its owner would pay the same fuel tax as a Hummer owner.

"You are arguing against people taking risks on technology development," said Beal, warning that some mile-tracking systems could invite fraud more than the reliable tax meters at the pump.

Any change in the state's gasoline tax would have to be approved by the Legislature.

Privacy advocates worry about the government tracking the whereabouts of every car in California. In one scenario — currently being tested in Oregon — tracking devices send a signal to a GPS satellite following the car, and that information would be used to calculate the tax bill. Other devices send a signal directly from the car to the pump, which calculates the tax based on the odometer reading.

Annalee Newitz, a policy analyst for the Electronic Frontier Foundation in San Francisco, which monitors privacy issues, said if the device "can communicate with a satellite and then communicate back with another device on the ground, it could be used for something else. That would be my concern: How are limits placed on how this device could be used?"

Yet some transportation experts say the technology has wider implications. Officials are intrigued by the idea because California could begin taxing people for using specific roads at specific times. To keep people off freeways at peak hours, for example, per-mile fees for city streets could be pegged at a lower rate than the highway. That could prompt people to use alternative routes.

Gates: ID Smart Cards to Replace Passwords

Bill Gates has made .Net the way into Microsoft - literally. Smart cards from Axalto have been commissioned as ID passes for all employees around the world, and the cards will be used to gain access to the buildings, as well as to get into software.

"The move towards smart cards is the way forward," said Gates in his keynote at IT Forum, in Copenhagen this morning. "The idea is to have a smart card that connects up in the best way - a .Net based smart card."

Microsoft partner Axalto "has done a super job on this", said Gates. "We will be using their smartcards internally - each employee will use those to get in and out of the buildings as we used to connect to our machines. We're requring them. We will completely replace passwords."

By having .Net capability, said Gates, "we think this brings different logic down to the card itself, giving a richness and continuity to the platform that only exists in that .Net environment." Axalto said this was the first commercial deployment of Axalto’s .Net-based smart cards.

The Cryptoflex .Net powered smart card "is a secure, ultra-miniature personal computing technology that runs a small footprint version of the .Net Framework", said Axalto. The .Net-based smart card provides customisable two-factor authentication as well as full cryptographic capabilities, seamlessly via the standard Microsoft .Net programming tools and interfaces. Microsoft marks the first enterprise deployment of the .Net-based smart card.

According to Charles Fitzgerald, general manager of platform strategy at Microsoft, these cards are based on the ECMA standards, and now form the core Microsoft .Net technologies

Axalto VP Marvin Tansley said: "The best approach to Network access security is to add a microprocessor card into the authentication process. Supporting Microsoft .Net is a natural extension of Axalto’s commitment to innovation around industry standards which enable secure access for many with varied identity management solutions."

The timescale is due to be short: tens of thousands of Microsoft employees worldwide already carry a corporate access badge that secures Microsoft computer systems and facilities. The Axalto Cryptoflex .Net powered smart card to its employees will be universal for secure remote Network access in 2005.

According to Axalto's official announcement, Microsoft's selected .Net-based cards are smart IDs that support both physical and logical access on one smart card. A contactless (RFID) feature embedded in the card provides the physical access to buildings and offices.

"The logical access control is provided via a microprocessor contact smart card with specialized security features, large memory for application storage, and implements Microsoft .Net," said the company.

The implementation includes a MSIL (Microsoft Intermediate Language) interpreter, application programming interfaces (system libraries needed for execution and smart card specific libraries for communication and security), and a converter that turns a CLI (common language infrastructure) compliant binary into a binary file for loading onto the smart card.

A set of relevant ECMA specifications and a comprehensive test suite that verifies compliance with the specs completes the package.

AMERICANS AGAINST ARNOLD

Americans Against Arnold has launched a campaign against the movement attempting to amend Article 2, Clause 5 of the United States Constitution that bars foreign usurpers from becoming President.

We have launched these defensive measures against Arnold Schwarzenegger's blitzkrieg attack on the Constitution because we love America and believe that the Founding Fathers were right: only someone born in America should be able to be President.

Just as important, we are dedicated to exposing the individual, Arnold Schwarzenegger, who is totally unfit to be Governor of California, much less President of the United States. Arnold Exposed.com will serve as a meticulously documented encyclopedia of Arnold's sinister, grotesque and even barbaric activities, from his nazi links to illegal drug use and sexual harassment.

The Founders forged Clause 5 of Article 2 of the Constitution to protect America from a foreign-born President holding dual or treacherous alliances with other countries.

Ironically, the Founding Fathers did this because, at the time of the ratification of the Constitution in 1789, a scandal was enveloping Europe concerning an Austrian government operation where Austrian agents would move to another European country as young men, become popular, and move into powerful elected positions, all the while serving their Austrian homeland.

In more modern times, we have the phenomenon of Adolf Hitler of Austria, who Schwarzenegger has spoken of admiringly, taking over Germany.

America is a wonderful place full of opportunities and is the most open to immigrants anywhere. If an American citizen went to Austria and told them that he wanted to be President he would be laughed at as an outlander. No country in the world would even consider having a foreigner as their President or their Prime Minister.

On top of it all, Arnold Schwarzenegger has never given up his dual-citizenship with Austria, and he is continually involved in Austria's internal politics.

The Arnold camp has talked about how, if he can't become US President he might move back to Austria and become President there. Good. Good riddance, we say.

After all, Arnold has campaigned in Austria before -- for nazi war criminal Kurt Waldheim. At the height of an international scandal in 1986 Arnold said in front of a crowd of family, friends and news media that he didn't care about Waldheim's nazi past, he was going to support him. He was even on campaign posters.

Even if you want to ignore all of the evidence showing what a dark character Schwarzenegger is, then pay attention to the polls which indicate that the vast majority of Americans, even naive Arnold supporters don't want him to be President.

Arnold's people certainly know this. That's why they've had everybody from Senator John McCain, Senator Ted Kennedy, Senator Orin Hatch, to Congressman Dana Rohrbacher out stumping for him in the weeks prior to his high-level political operatives launching this transparently fake "grassroots" campaign, Amend for Arnold.

Congressman Dana Rohrbacher, after introducing a Bill in the House (one of four bills all dubbed "Arnold Bills") that would repeal the law barring Schwarzenegger from being President, told the press that the bill wasn't for Arnold, but was for all immigrants.

Then, three weeks later, he told the San Jose Mercury-News that top Republicans want to clear the way for Arnold to run for the Presidency, and they need him when Bush is done in '08.

There has been wall to wall glowing media coverage for the last month, including Arnold on 60 Minutes telling us how wonderful he is and pushing for the Constitution to be changed.

Bottom line: Arnold Schwarzenegger is a despicable creature with more baggage than a jumbo jet loaded with passengers. He can never be our President because he is so compromised. And that's why the establishment loves him: at any time if he doesn't play ball and do exactly what he's told they can open the floodgates, releasing a cesspool of dirt.

The people don't want him, but the elite does. Don't let them put perfume on a pig, join us in standing up for America against this foreign , narcissistic carpetbagger that is Arnold Alois Schwarzenegger

THE CONSTITUTION

Arnold and his political operatives are seeking to change the below listed cornerstone of the US Constitution, and for some reason the media is falsely reporting that Arnold needs to have the 22nd Amendment removed, which deals with the President only being able to serve two terms.

ARTICLE 2, SECTION 5

It's an urban legend that the 22nd Amendment is blocking Arnold. It is Article 2, Clause 5 of the Constitution itself that bars him. Here is its text:

Article 2 Clause 5 of the US Constitution States: No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Note: if the Bills moving through Congress promoting making it possible for Arnold to run for President are successful in opening up a Constitutional Convention, the entire Bill of Rights and Constitution are wide-open to be totally changed.

Constitutional Conventions are very, very dangerous. Regardless of which side of the political spectrum you consider yourself to be on, a Con-con is bad news. An amendment could be passed further legalizing abortion or, conversely a law banning it. The Second Amendment could be removed.

We're talking about a dangerous free-for-all where special interests from all sides destroy America. Anything could happen, and this is the type of Constitutional crisis that Arnold is made for. There's a move on right now to open up a Constitutional Convention for a flag-burning amendment. They're also trying to get one for gay marriage.

The Bills are waiting right now in Congress to piggyback an amendment for Arnold on any of these measures. So look out, and take this very seriously. Arnold isn't spending all his time and energy pushing a Constitutional amendment for nothing.

AMERICANS AGAINST ARNOLD

Americans Against Arnold represents the majority view that a foreigner, especially Arnold Schwarzenegger, should not be eligible to be our President. We know that if Americans learn the facts about Arnold they will be as scared as we are of this sinister figure.

Documentary filmmaker and radio host Alex Jones founded Americans Against Arnold to unite the American people in a grassroots effort to counter Arnold Schwarzenegger and his forces attempt to butcher the United States Constitution.

HOW WE WOKE UP TO THE TRUTH ABOUT ARNOLD

Alex Jones was once like most Americans. He thought that Arnold was just a popular movie star who grew up in Austria. He was in the unique position of preparing for his radio show five days a week, so he read a lot of news and became more informed about Arnold Schwarzenegger than the average American.

Jones had read scores of news articles from respected publications about how Arnold had been involved in drug use. He learned that Arnold openly spoke of admiring dictators, that he someday wanted to be President of the United States.

To his horror, he then found an MSNBC article where Arnold publicly stated that he loved Kurt Waldheim and didn't care about his nazi affiliations. This was revealed at the height of an international scandal involving Kurt Waldheim who had just been outed as a top nazi in WWII. In the middle of the scandal, Arnold went to Austria and campaigned for Kurt Waldheim, who has been attributed to putting out wartime flyers in Serbia telling the population to kill all Jews.

Alex Jones learned all this five years ago and thought to himself that there was no way that this megalomaniac who has said he admires Hitler could ever be President. Then Jones read in the San Francisco Chronicle where Karl Rove and others pushed for Schwarzenegger to run for the Governorship of California.

Jones began to watch Arnold much more closely and did detailed research on Schwarzenegger. The picture of Arnold only got worse: his link to the California Enron scandal, multiple independent unchallenged sources who personally said Arnold screamed racial slurs at them in public, legions of women who have been subjected to his pig-like treatment, including sexual harassment, and, as Arnold has said, "where there's smoke there's fire," his admission that he has used steroids makes him a horrible role model to children and athletes.

It just goes on and on...

Alex isn't the only one who has noticed. Scores of prominent people on both sides of the political spectrum have written editorials and appeared on television decrying Arnold's reprehensible behavior.

All of that ended when he was elected Governor. Now the mainstream media fawns at this creature's feet, despite the fact that polls show that 80+ percent of Americans are opposed to a foreign born President. Even more are opposed in polls where Arnold is mentioned.

Jones has received hundreds of emails and calls from across the country from people on the left and right who are upset about the fact that the media is now ignoring Arnold's agenda and past.

The general sentiment on the street is that Arnold is scary, a misogynist and a would-be dictator. No one we've talked to thinks he should be able to be President. Still, we have all these heavy-hitters from both parties running a campaign for him.

We hope the media will pay attention to the vast majority of American who are against Arnold and that they will start exposing what he is.

Our main mission is to defend Article 2, Section 5 of the United States Constitution, which defends our national sovereignty.

Alex Jones says, "What is this, a sick joke? No other country would even entertain the idea of having a foreigner for President. And who is the elite pushing? Arnold Schwarzenegger -- who has more skeletons in and out of the closet than a mausoleum."

Arnold has said for decades that he wants to amend the Constitution so he can be President. A Texas radio host launched a Web-based offensive Thursday against efforts to change the U.S. Constitution to allow Gov. Arnold Schwarzenegger to run for president of the United States.

Alex Jones, an Austin-based talk show host on the Burnsville, Minn., Genesis Communications Network, said the site raised $5,000 for an anti-Schwarzenegger campaign in its first two hours.

Jones, once voted Austin's favorite radio host and sometimes described as a "conspiracy theorist," said he's raising funds to run TV ads in Austin and Sacramento to counter those beginning this week by Schwarzenegger supporters hoping he'll run for president.

"This is serious," he said. "Arnold is serious. His people are serious."

Jones, 30, said most Americans don't support changing the Constitution to clear the way for a Schwarzenegger presidency. The talk show host who rails daily against globalism, the United Nations and World Bank on satellite and Internet radio, criticizes Schwarzenegger for admitted past drug use and mistreatment of women, and accuses him of Nazi sympathies.

"He's all over TV getting wall-to-wall major news cycle coverage for weeks on end," Jones said. "This is a campaign and his operatives are pushing it. It deserves to be countered."

Jones' unveiled his Web site, www.arnoldexposed.com , as a Silicon Valley-based group begins airing ads supporting the constitutional change. Its ads and a companion Web site, " www.amendforarnold.com , are sponsored by Lissa Morgenthaler-Jones, a Bay Area mutual fund manager and Schwarzenegger campaign donor.

Schwarzenegger aides declined comment on either campaign. But the governor said Tuesday on CNN's Larry King Live that he supports an amendment.

Four proposed amendments are before Congress, but none is moving through the legislative process. Constitutional amendments must be approved by two-thirds of both houses of Congress and then ratified by 38 states to take effect.

Schwarzenegger and White Supremacy

*ABCNEWS obtained a copy of an unpublished book proposal with quotes from a
verbatim transcript of an interview Schwarzenegger gave in 1975 while making
the film Pumping Iron. Asked who his heroes are, he answered, "I admired Hitler,
for instance, because he came from being a little man with almost no formal
education, up to power. I admire him for being such a good public speaker and
for what he did with it."

* Arnold Schwarzenegger has a well-documented longtime relationhip with Kurt
Waldheim, whom he invited to his wedding in Massachusetts in 1986. At the
time, Waldheim, a former United Nations secretary-general, was running a
successful campaign that would see him elected to the Austrian presidency, while
conveniently "forgetting" his own central role in Nazi atrocities.

Waldheim didn't attend the wedding, but Schwarzenegger offered a tribute that
stunned the assemblage into shocked silence: "My friends don't want me to
mention Kurt's name, because of all the recent Nazi stuff and the U.N.
controversy, but I love him and Maria does too, and so thank you. Kurt." After the
wedding, Schwarzenegger permitted Waldheim to use his name on campaign posters,
protested a year later when Waldheim, then president of Austria, was banned from
entering the United States, and was seen in Waldheim's company as recently as
1998.

* I n 2000 Scottish Daily Record & Sunday Mail reported "Austria's right-wing
strongman Jorg Haider has the grudging support of his fellow-countryman,
muscleman Arnold Schwarzenegger, who praises him as "a very charismatic leader.
"Some of his ideas are good," says Schwarzenegger. But the action star, who
takes an active interest in both Austrian and American politics, hastens to add:
"There are some issues I have a problem with."

The Jerusalem Post reported that Arnold Schwarzenegger was photographed in
1996 with Jorg Haider, leader of Austria's extreme right-wing Freedom Party.
Haider has praised Hitler's "sensible policies" and also been filmed at a secret
SS reunion.

* Rick Wayne -- a black bodybuilder from St. Lucia, a Caribbean island --
said Schwarzenegger defended the apartheid system and argued that white South
Africans could not turn power over to black South Africans without ruining the
nation. "At the time, I just thought he was an out-and-out racist,'' Wayne said
in a recent interview. Wayne said he watched Schwarzenegger upset Jewish
friend Joe Weider to the point of tears with his crass jokes, which included doing
an impression of Hitler.

* Robby Robinson, a former Mr. America, Mr. World and Mr. Universe
titleholder, who worked with Schwarzenegger in the 1970s claims Schwarzenegger
repeatedly directed the term "******" at him. Said Robinson, "That he (Arnold) would
use, down with the blacks to 40 or 50 people, I'm the only black person in there
and the head of the company, Weider, is there, all the officials are there. I
mean everybody was in there. In walked this person he looks at me, down with
the black this, ******, this, I am thinking, hold it. I'm not hearing this, I
didn't think my brain was hearing this."

* Schwarzenegger, who claims to be a friend of immigrants, recently told
reporters, "I love immigrants. You know, I'm an immigrant myself." But despite his
statement of the obvious, it turns out that in 1994 he voted for California's
proposition 187 -- the controversial ballot initiative that strove to cut
health care and public education for undocumented immigrants. The measure was
eventually ruled unconstitutional. The driving force behind Prop 187 -- former
governor of California Pete Wilson -- is Schwarzenegger's campaign chairman. But
Schwarzengger's close connection with the anti-immigrant legislation doesn't
end with Wilson. Don Sipple, Arnie's new media consultant (a confirmed wife
beater), created the harsh television commercials promoting the anti-immigrant
initiative. The doomsday ads featured a grim narration voice warning viewers
that illegal immigrants just "keep coming."

* The Washington Post reported Arnold Schwarzenegger also has a 15-year-long
relationship to an English only organization called US ENGLISH with "ties to
right-wing nationalist movements that have stirred controversy for other
politicians such as Mississippi Republican Sen. Trent Lott." Further, "John Tanton
(US ENGLISH co-founder), is considered the modern-day godfather of the
anti-immigration movement. He has founded or helped fund at least 13 anti-immigration
groups, three of which are listed as "hate groups" by the Southern Poverty Law
Center." US ENGLISH spokesperson James Lubinskas, is a "contributing editor
of the August 2003 issue of American Renaissance magazine, published by a
leader of the white-supremacist group Council of Conservative Citizens, which is
also listed by SPLC as a hate group. Lubinskas has long ties to right-wing
nationalist groups, such as American Friends of the British Nationalist Party.
Lubinskas has shared a stage with former Louisiana Klansman David Duke.
Schwarzenegger is still a member of the US ENGLISH advisory board. Lubinskas "resigned"
on August 19, 2003 just days after the Washington Post article was posted.

* How much impact did his father's views have on him?
The Los Angles Times reported (Austrian Archives Reveal Nazi Military Role of
Actor's Father- August 14, 2003), Arnold Schwarzenegger’s father Gustav had
"a deeper involvement in Hitler's regime than the Simon Wiesenthal Center had
uncovered in their investigation commissioned by the actor. A document found in
Austria shows Gustav Schwarzenegger was indeed a member of the
Sturmabteilungen (SA), also known as the "storm troopers" or "brown shirts." Gustav
Schwarzenegger joined the SA on May 1, 1939, — about six months after the
storm-troopers helped launch Kristallnacht, the Night of the Broken Glass, when Jewish
homes, businesses and synagogues were attacked across Germany and Austria and
thousands of Jews were hauled off to concentration camps. Gustav Schwarzenegger
served with German Army units that saw some of the most brutal bloodshed of
World War II, including the invasions of Poland and France and the German rampage
through Russia and the siege of Leningrad.

A Brief Analysis of the Domestic Security Enhancement Act 2003
- Also Known as USA Patriot Act II

Congressman Ron Paul (R-Tex) told the Washington Times that no member of Congress was allowed to read the first Patriot Act that was passed by the House on October 27, 2001. The first Patriot Act was universally decried by civil libertarians and Constitutional scholars from across the political spectrum. William Safire, while writing for the New York Times, described the first Patriot Act's powers by saying that President Bush was "seizing dictatorial control." On February 7, 2003 the Center for Public Integrity, a non-partisan public interest think-tank in DC, revealed the full text of the Domestic Security Enhancement Act of 2003. The classified document had been leaked to them by an unnamed source inside the Federal government. The document consisted of a 33 page section by section analysis of the accompanying 87 page bill.

The bill itself is stamped "Confidential - Not for Distribution." Upon reading the analysis and bill, I was stunned by the scientifically crafted tyranny contained in the legislation. The Justice Department Office of Legislative Affairs admits that they had indeed covertly transmitted a copy of the legislation to Speaker of the House Dennis Hastert, (R-Il) and the Vice President of the United States, Dick Cheney as well as the executive heads of federal law enforcement agencies.

It is important to note that no member of Congress was allowed to see the first Patriot Act before its passage, and that no debate was tolerate by the House and Senate leadership. The intentions of the White House and Speaker Hastert concerning Patriot Act II appear to be a carbon copy replay of the events that led to the unprecedented passage of the first Patriot Act.

There are two glaring areas that need to be looked at concerning this new legislation:

1. The secretive tactics being used by the White House and Speaker Hastert to keep even the existence of this legislation secret would be more at home in Communist China than in the United States. The fact that Dick Cheney publicly managed the steamroller passage of the first Patriot Act, ensuring that no one was allowed to read it and publicly threatening members of Congress that if they didn't vote in favor of it that they would be blamed for the next terrorist attack, is by the White House's own definition terrorism. The move to clandestinely craft and then bully passage of any legislation by the Executive Branch is clearly an impeachable offense.

2. The second Patriot Act is a mirror image of powers that Julius Caesar and Adolf Hitler gave themselves. Whereas the First Patriot Act only gutted the First, Third, Fourth and Fifth Amendments, and seriously damaged the Seventh and the Tenth, the Second Patriot Act reorganizes the entire Federal government as well as many areas of state government under the dictatorial control of the Justice Department, the Office of Homeland Security and the FEMA NORTHCOM military command. The Domestic Security Enhancement Act 2003, also known as the Second Patriot Act is by its very structure the definition of dictatorship.

I challenge all Americans to study the new Patriot Act and to compare it to the Constitution, Bill of Rights and Declaration of Independence. Ninety percent of the act has nothing to do with terrorism and is instead a giant Federal power-grab with tentacles reaching into every facet of our society. It strips American citizens of all of their rights and grants the government and its private agents total immunity. Here is a quick thumbnail sketch of just some of the draconian measures encapsulated within this tyrannical legislation:

SECTION 501 (Expatriation of Terrorists) expands the Bush administration's "enemy combatant" definition to all American citizens who "may" have violated any provision of Section 802 of the first Patriot Act. (Section 802 is the new definition of domestic terrorism, and the definition is "any action that endangers human life that is a violation of any Federal or State law.") Section 501 of the second Patriot Act directly connects to Section 125 of the same act. The Justice Department boldly claims that the incredibly broad Section 802 of the First USA Patriot Act isn't broad enough and that a new, unlimited definition of terrorism is needed.

Under Section 501 a US citizen engaging in lawful activities can be grabbed off the street and thrown into a van never to be seen again. The Justice Department states that they can do this because the person "had inferred from conduct" that they were not a US citizen. Remember Section 802 of the First USA Patriot Act states that any violation of Federal or State law can result in the "enemy combatant" terrorist designation.

SECTION 201 of the second Patriot Act makes it a criminal act for any member of the government or any citizen to release any information concerning the incarceration or whereabouts of detainees. It also states that law enforcement does not even have to tell the press who they have arrested and they never have to release the names.

SECTION 301 and 306 (Terrorist Identification Database) set up a national database of "suspected terrorists" and radically expand the database to include anyone associated with suspected terrorist groups and anyone involved in crimes or having supported any group designated as "terrorist." These sections also set up a national DNA database for anyone on probation or who has been on probation for any crime, and orders State governments to collect the DNA for the Federal government.

SECTION 312 gives immunity to law enforcement engaging in spying operations against the American people and would place substantial restrictions on court injunctions against Federal violations of civil rights across the board.

SECTION 101 will designate individual terrorists as foreign powers and again strip them of all rights under the "enemy combatant" designation.

SECTION 102 states clearly that any information gathering, regardless of whether or not those activities are illegal, can be considered to be clandestine intelligence activities for a foreign power. This makes news gathering illegal.

SECTION 103 allows the Federal government to use wartime martial law powers domestically and internationally without Congress declaring that a state of war exists.

SECTION 106 is bone-chilling in its straightforwardness. It states that broad general warrants by the secret FSIA court (a panel of secret judges set up in a star chamber system that convenes in an undisclosed location) granted under the first Patriot Act are not good enough. It states that government agents must be given immunity for carrying out searches with no prior court approval. This section throws out the entire Fourth Amendment against unreasonable searches and seizures.

SECTION 109 allows secret star chamber courts to issue contempt charges against any individual or corporation who refuses to incriminate themselves or others. This sections annihilate the last vestiges of the Fifth Amendment.

SECTION 110 restates that key police state clauses in the first Patriot Act were not sunsetted and removes the five year sunset clause from other subsections of the first Patriot Act. After all, the media has told us: "This is the New America. Get used to it. This is forever."

SECTION 111 expands the definition of the "enemy combatant" designation.

SECTION 122 restates the government's newly announced power of "surveillance without a court order."

SECTION 123 restates that the government no longer needs warrants and that the investigations can be a giant dragnet-style sweep described in press reports about the Total Information Awareness Network. One passage reads, "thus the focus of domestic surveillance may be less precise than that directed against more conventional types of crime."

*Note: Over and over again, in subsection after subsection, the second Patriot Act states that its new Soviet-type powers will be used to fight international terrorism, domestic terrorism and other types of crimes. Of course the government has already announced in Section 802 of the first USA Patriot act that any crime is considered domestic terrorism.

SECTION 126 grants the government the right to mine the entire spectrum of public and private sector information from bank records to educational and medical records. This is the enacting law to allow ECHELON and the Total Information Awareness Network to break down any and all walls of privacy. The government states that they must look at everything to "determine" if individuals or groups might have a connection to terrorist groups. As you can now see, you are guilty until proven innocent.

SECTION 127 allows the government to takeover coroners' and medical examiners' operations whenever they see fit. See how this is like Bill Clinton's special medical examiner he had in Arkansas that ruled that people had committed suicide when their arms and legs had been cut off.

SECTION 128 allows the Federal government to place gag orders on Federal and State Grand Juries and to take over the proceedings. It also disallows individuals or organizations to even try to quash a Federal subpoena. So now defending yourself will be a terrorist action.

SECTION 129 destroys any remaining whistle blower protection for Federal agents.

SECTION 202 allows corporations to keep secret their activities with toxic biological, chemical or radiological materials.

SECTION 205 allows top Federal officials to keep all their financial dealings secret, and anyone investigating them can be considered a terrorist. This should be very useful for Dick Cheney to stop anyone investigating Haliburton.

SECTION 303 sets up national DNA database of suspected terrorists. The database will also be used to "stop other unlawful activities." It will share the information with state, local and foreign agencies for the same purposes.

SECTION 311 federalizes your local police department in the area of information sharing.

SECTION 313 provides liability protection for businesses, especially big businesses that spy on their customers for Homeland Security, violating their privacy agreements. It goes on to say that these are all preventative measures - has anyone seen Minority Report? This is the access hub for the Total Information Awareness Network.

SECTION 321 authorizes foreign governments to spy on the American people and to share information with foreign governments.

SECTION 322 removes Congress from the extradition process and allows officers of the Homeland Security complex to extradite American citizens anywhere they wish. It also allows Homeland Security to secretly take individuals out of foreign countries.

SECTION 402 is titled "Providing Material Support to Terrorism." The section reads that there is no requirement to show that the individual even had the intent to aid terrorists.

SECTION 403 expands the definition of weapons of mass destruction to include any activity that affects interstate or foreign commerce.

SECTION 404 makes it a crime for a terrorist or "other criminals" to use encryption in the commission of a crime.

SECTION 408 creates "lifetime parole" (basically, slavery) for a whole host of crimes.

SECTION 410 creates no statute of limitations for anyone that engages in terrorist actions or supports terrorists. Remember: any crime is now considered terrorism under the first Patriot Act.

SECTION 411 expands crimes that are punishable by death. Again, they point to Section 802 of the first Patriot Act and state that any terrorist act or support of terrorist act can result in the death penalty.

SECTION 421 increases penalties for terrorist financing. This section states that any type of financial activity connected to terrorism will result to time in prison and $10-50,000 fines per violation.

SECTION 427 sets up asset forfeiture provisions for anyone engaging in terrorist activities. There are many other sections that I did not cover in the interest of time. The American people were shocked by the despotic nature of the first Patriot Act. The second Patriot Act dwarfs all police state legislation in modern world history.

Usually, corrupt governments allow their citizens lots of wonderful rights on paper, while carrying out their jackbooted oppression covertly. From snatch and grab operations to warantless searches, Patriot Act II is an Adolf Hitler wish list.

You can understand why President Bush/Dick Cheney & Dennis Hastert want to keep this legislation secret not just from Congress, but the American people as well. Bill Allison, Managing Editor of the Center for Public Integrity, the group that broke this story, stated on my radio show that it was obvious that they were just waiting for another terrorist attack to opportunistically get this new bill through. He then shocked me with an insightful comment about how the Federal government was crafting this so that they could go after the American people in general. He also agreed that the FBI has been quietly demonizing patriots and Christians and those who carry around pocket Constitutions.

I heard this stuff through Alex (might have heard it on Merklinger's show as well). When people like Alex start talking about things like tracking devices in cars, there are people who will just call them nut cases. Well, he's not, and people need to wake up. I wonder what it's gonna take for people to realize what is going on.

I saw that one at the theaters and do have a video that I have never opened. Didn't have to since TNT shows it all the time. This response came from the Vice-President of a Tennessee based CBS affiliate.

In the E mail, he likens Alex Jones and the Americans Against Arnold movement to the Klu Klux Klan, saying they are "probable threat to our freedom and safety and are not fit to carry Governor Schwarzenegger’s luggage."

It is completely baffling to try to understand the logic in play here. We are opposing someone who said publicly that they admired Hitler and campaigned in Austria for admitted Nazi Kurt Waldheim.

President Bush plans to unveil next month a sweeping mental health initiative that recommends screening for every citizen and promotes the use of expensive antidepressants and antipsychotic drugs favored by supporters of the administration.

The New Freedom Initiative, according to a progress report , seeks to integrate mentally ill patients fully into the community by providing "services in the community, rather than institutions," the British Medical Journal reported.

Critics say the plan protects the profits of drug companies at the expense of the public.

The initiative began with Bush's launch in April 2002 of the New Freedom Commission on Mental Health, which conducted a "comprehensive study of the United States mental health service delivery system."

The panel found that "despite their prevalence, mental disorders often go undiagnosed" and recommended comprehensive mental health screening for "consumers of all ages," including preschool children.

The commission said, "Each year, young children are expelled from preschools and childcare facilities for severely disruptive behaviors and emotional disorders."

Schools, the panel concluded, are in a "key position" to screen the 52 million students and 6 million adults who work at the schools.

The commission recommended that the screening be linked with "treatment and supports," including "state-of-the-art treatments" using "specific medications for specific conditions."

The Texas Medication Algorithm Project, or TMAP, was held up by the panel as a "model" medication treatment plan that "illustrates an evidence-based practice that results in better consumer outcomes."

The TMAP -- started in 1995 as an alliance of individuals from the pharmaceutical industry, the University of Texas and the mental health and corrections systems of Texas -- also was praised by the American Psychiatric Association, which called for increased funding to implement the overall plan.

But the Texas project sparked controversy when a Pennsylvania government employee revealed state officials with influence over the plan had received money and perks from drug companies who stand to gain from it.

Allen Jones, an employee of the Pennsylvania Office of the Inspector General says in his whistleblower report the "political/pharmaceutical alliance" that developed the Texas project, which promotes the use of newer, more expensive antidepressants and antipsychotic drugs, was behind the recommendations of the New Freedom Commission, which were "poised to consolidate the TMAP effort into a comprehensive national policy to treat mental illness with expensive, patented medications of questionable benefit and deadly side effects, and to force private insurers to pick up more of the tab."

Jones points out, according to the British Medical Journal, companies that helped start the Texas project are major contributors to Bush's election funds. Also, some members of the New Freedom Commission have served on advisory boards for these same companies, while others have direct ties to TMAP.

Eli Lilly, manufacturer of olanzapine, one of the drugs recommended in the plan, has multiple ties to the Bush administration, BMJ says. The elder President Bush was a member of Lilly's board of directors and President Bush appointed Lilly's chief executive officer, Sidney Taurel, to the Homeland Security Council.

Of Lilly's $1.6 million in political contributions in 2000, 82 percent went to Bush and the Republican Party.

Another critic, Robert Whitaker, journalist and author of "Mad in America," told the British Medical Journal that while increased screening "may seem defensible," it could also be seen as "fishing for customers."

Exorbitant spending on new drugs "robs from other forms of care such as job training and shelter program," he said.

However, a developer of the Texas project, Dr. Graham Emslie, defends screening.

"There are good data showing that if you identify kids at an earlier age who are aggressive, you can intervene ... and change their trajectory."

Rep. Ron Paul, R-Texas, plans to offer an amendment in the House of Representatives today that would remove from an appropriations bill a new mandatory mental-health screening program for America's children.

"The American tradition of parents deciding what is best for their children is, yet again, under attack," writes Kent Snyder of the Paul-founded Liberty Committee. "The pharmaceutical industry has convinced President Bush to support mandatory mental-health screening for every child in America, including preschool children, and the industry is now working to convince Congress as well."

As WorldNetDaily reported, the New Freedom Initiative recommends screening not only for children but eventually for every American. The initiative came out of the New Freedom Commission on Mental Health, which President Bush established in 2002.

Critics of the plan say it is a thinly veiled attempt by drug companies to provide a wider market for high-priced antidepressants and antipsychotic medication, and puts government in areas of Americans' lives where it does not belong.

Writes Snyder: "The real payoff for the drug companies is the forced drugging of children that will result – as we learned tragically with Ritalin – even when parents refuse."

Paul's amendment to the Labor, HHS and Education Appropriations Act for Fiscal Year 2005 would take the new program out of the funding bill.

The congressman, who is known for his strict adherence to the Constitution, wrote in a letter to his colleagues: "As you know, psychotropic drugs are increasingly prescribed for children who show nothing more than children's typical rambunctious behavior. Many children have suffered harmful effects from these drugs. Yet some parents have even been charged with child abuse for refusing to drug their children. The federal government should not promote national mental-health screening programs that will force the use of these psychotropic drugs such as Ritalin."

Members of the Illinois Children's Mental Health Partnership have held several public hearings on the program in recent months, hearing from parents and others who oppose the mandatory screening.

Karen R. Effrem, M.D., is a physician and leading opponent of mandatory screening. She is on the board of directors of EdWatch, an organization that actively opposes federal control of education.

"I am concerned, especially in the schools, that mental health could be used as a wedge for diagnosis based on attitudes, values, beliefs and political stances – things like perceived homophobia," Effrem told WorldNetDaily.

"There are several violence-prevention programs that do say if a person is homophobic, they could be considered potentially violent."

Continued Effrem: "This mental-health program could be used as an enforcement tool to impose a very politically correct, anti-American curriculum."

Effrem emphasized the new program has no guarantees of parental rights, noting some children have died because parents were coerced to put their kids on psychiatric medications.

Snyder says the following groups have come out in opposition to the screening program: Eagle Forum, Gun Owners of America, the Association of American Physicians and Surgeons, Concerned Women of America, Freedom 21, the Alliance for Human Research Protection, and the International Center for the Study of Psychiatry and Psychology.

A screening program in Paul's home state began nearly ten years ago. The Texas Medication Algorithm Project, or TMAP, was held up by the New Freedom Commission as a "model" medication treatment plan that "illustrates an evidence-based practice that results in better consumer outcomes."

The TMAP – started in 1995 as an alliance of individuals from the pharmaceutical industry, the University of Texas and the mental health and corrections systems of Texas – also was praised by the American Psychiatric Association, which called for increased funding to implement the overall plan.

But the Texas project sparked controversy when a Pennsylvania government employee revealed state officials with influence over the plan had received money and perks from drug companies who stand to gain from it.

Allen Jones, an employee of the Pennsylvania Office of the Inspector General says in his whistleblower report the "political/pharmaceutical alliance" that developed the Texas project, which promotes the use of newer, more expensive antidepressants and antipsychotic drugs, was behind the recommendations of the New Freedom Commission, which were "poised to consolidate the TMAP effort into a comprehensive national policy to treat mental illness with expensive, patented medications of questionable benefit and deadly side effects, and to force private insurers to pick up more of the tab."

Jones points out, according to a British Medical Journal report, companies that helped start the Texas project are major contributors to Bush's re-election. Also, some members of the New Freedom Commission have served on advisory boards for these same companies, while others have direct ties to TMAP.

AN AL-QAEDA terror plot involving aircraft being flown simultaneously into the towers of Canary Wharf and Heathrow Airport has been foiled by British security forces, it emerged last night.

The 9/11-style attacks on the two high-profile London targets are among four or five al-Qaeda strikes that security chiefs believe they have stopped, it was reported.

According to a senior authoritative source last night, training programmes for suicide pilots have been disrupted and the devastating attacks foiled. The Home Office and Metropolitan Police declined to comment on the reports.

Security has been heightened around strategic centres across the capital in the wake of the 2001 attacks, which have plunged the world into a series of conflicts aimed at defeating terrorism.

Last night, Dr Magnus Ranstorp, the director of the Centre for the Study of Terrorism and Political Violence at St Andrews University, said Canary Wharf would be an obvious target as it was the financial centre of London’s Docklands district, and Heathrow was the capital’s main airport. He said: "If this is the case, then of course there may have been different degrees of development and preparation for such attacks - it may not have been fully operational plans that were either days or hours away.

"There has already been a security clampdown around Heathrow, and that decision in itself was not taken lightly given the political and economic consequences of such an action.

"If this is the case it would justify what the security services and principal counter-terrorism officials have been saying for some time, that there is a danger and they have been working over-time to try and prevent this threat.

"Canary Wharf, and the City itself, is an obvious target as it is in the financial district of London and therefore remains a major economic target for terrorists.

"It is a great credit to the law enforcement and security services who are carrying out one of the more advanced counter-terrorism operations in Europe."

Regarding the alleged disruption of suicide pilot training courses, Dr Ranstorp said: "The significance of this would depend on whether these suicide training exercises were disrupted within the United Kingdom, and what they actually consisted of in terms of preparation, such as the indoctrination of key individuals.

"There are different degrees of preparation - from initial planning to training to deployment - so the significance of this would depend on at what stage the operations were disrupted."

More than 2,700 people died in the attacks on the World Trade Centre and the Pentagon more than three years ago.

News of the plots against British targets came ahead of a Queen’s Speech, which is expected to be dominated by the issue of security. Numerous bills tackling terrorism, organised crime and anti-social behaviour have been trailed.

Home Secretary David Blunkett’s more controversial proposals, such as the use in court of evidence acquired by wire taps, will be shelved until after the General Election expected in May.

However, the government’s programme will set the scene for a poll campaign Tony Blair is said to want to fight on security. Opponents have accused the Home Secretary of deliberately creating a climate of fear.

Mr Blunkett has recently insisted that Labour will campaign on hope not fear, but then warned that forthcoming trials will show al-Qaeda are "on our doorstep and threatening lives". His comments came after Metropolitan Police Commissioner Sir John Stevens spoke of his frustration at not being able to talk about anti-terror successes.

MI5 chief Eliza Manningham-Buller also spoke publicly about Britain’s success in thwarting fanatics. Mr Blair faced accusations of alarmism 18 months ago when troops in armoured vehicles surrounded Heathrow Airport.

However, the government insisted that the dramatic action came in response to specific intelligence.

It was not clear whether it was this event that thwarted one of up to five strikes reportedly prevented since the 2001 US attacks, and which ITV News was reporting last night.

JFK Shooting Game Provokes Anger

A Scottish firm has been criticised by the family of John F Kennedy for producing a game which recreates the president's assassination in Dallas.

"JFK Reloaded" was released on Monday to coincide with the 41st anniversary of the president's assassination.

David Smith, a spokesman for Senator Ted Kennedy, the brother of JFK, said the PC-based game was "despicable".

A spokesman for Traffic Games said it was encouraging youngsters to take an interest in history.

The Stirling-based company argued that the game was aimed at disproving theories that a conspiracy, rather than lone gunman Lee Harvey Oswald, was responsible for the assassination.

The creators said they had written to Senator Kennedy before the release of the game, which allows players to simulate the shooting.

Kirk Ewing, company managing director and a former documentary film maker, said he understood that some people would be horrified at the game but went on: "We have an enormous respect for the Kennedy family.

"What we are hoping to do is re-ignite people's passion for history. This is a unique insight into the assassination. We think there's a whole generation of people who have no experience of the Kennedy assassination.

"The game is effectively a reconstruction of the event using video game technology.

"I hasten to add that we don't regard it as a video game because there's no imagination been used to create the scene."

Mr Ewing said: "It's been covered in every kind of media so far, whether in books or movies, so what we've done is really just to extend that into the interactive media."

One of the nation's leading medical groups, the Association of American Physicians & Surgeons (AAPS), decried a move by the U.S. Senate to join with the House in funding a federal program AAPS says will lead to mandatory psychological testing of every child in America – without the consent of parents.

When the Senate considered an omnibus appropriations bill last week that included funding for grants to implement universal mental health screening for almost 60 million children, pregnant women and adults through schools and pre-schools, it approved $20 million of the $44 million sought, Kathryn Serkes, public affairs counsel for AAPS, told NewsMax.

This $20 million matches a like amount already approved by the House, Serkes advised.

While the funding cut of some $24 million was a little good news, suggested Serkes, whose organization has zealously opposed the the measure, she said the organization was most worried about the failure of Congress to include “parental consent” language sought by the AAPS.

Last September, AAPS lifetime member Rep. Ron Paul, M.D., R-Texas, tried to stop the plan in its tracks by offering an amendment to the Labor, HHS, and Education Appropriations Act for FY 2005. The amendment received 95 “yes” votes, but it failed to pass.

According to Serkes, Paul is now mulling offering stand-alone legislation in the next session to once again try and get a provision for parental consent.

The federal bill on its face does not require mandatory mental health testing to be imposed upon states or local schools, explained Serkes.

However, the HHS appropriations bill contains block grant money that will likely be used – as is often the case with block funding – by the various states to implement mandatory psychological testing programs for all students in the school system.

The spending bill has its roots in the recommendations of the New Freedom Commission on Mental Health, created by President Bush in 2002 to propose ways of eliminating waste and improve efficiency and effectiveness of the mental health care delivery system.

Although the report does not specifically recommend screening all students, it does suggest that “schools are in a key position to identify the mental health problems early and to provide a link to appropriate services.”

The bottom line, explained Serkes, is that a state receiving money under this appropriation will likely make its mental testing of kids mandatory – and not be out of synch with the federal enactment.

The other telling point, said Serkes, is that although the relatively minimal funding at this point is certainly not enough to fund mandatory mental testing for kids countrywide, it's an ominous start:

“Once it's established and has funding, a program exhibits the nettlesome property of being self-sustaining – it gets a life of its own. More funding follows.”

Officials of the AAPS decry in the measure what they see as “a dangerous scheme that will heap even more coercive pressure on parents to medicate children with potentially dangerous side effects.”

One of the most “dangerous side effects” from antidepressants commonly prescribed to children is suicide, regarding which AAPS added, “Further, even the government's own task force has concluded that mental health screening does little to prevent suicide.”

Meanwhile, Rep. Paul says the mental testing scheme is a looming feature of "Big Brother" that if unchecked will push parental rights out of the picture:

“At issue is the fundamental right of parents to decide what medical treatment is appropriate for their children. The notion of federal bureaucrats ordering potentially millions of youngsters to take psychotropic drugs like Ritalin strikes an emotional chord with American parents, who are sick of relinquishing more and more parental control to government.

“Once created, federal programs are nearly impossible to eliminate. Anyone who understands bureaucracies knows they assume more and more power incrementally. A few scattered state programs over time will be replaced by a federal program implemented in a few select cities. Once the limited federal program is accepted, it will be expanded nationwide. Once in place throughout the country, the screening program will become mandatory.

“Soviet communists attempted to paint all opposition to the state as mental illness. It now seems our own federal government wants to create a therapeutic nanny state, beginning with schoolchildren. It's not hard to imagine a time 20 or 30 years from now when government psychiatrists stigmatize children whose religious, social, or political values do not comport with those of the politically correct, secular state.

“American parents must do everything they can to remain responsible for their children's well-being. If we allow government to become intimately involved with our children's minds and bodies, we will have lost the final vestiges of parental authority. Strong families are the last line of defense against an overreaching bureaucratic state.”

President Bush plans to unveil next month a sweeping mental health initiative that recommends screening for every citizen and promotes the use of expensive antidepressants and antipsychotic drugs favored by supporters of the administration.

The New Freedom Initiative, according to a progress report , seeks to integrate mentally ill patients fully into the community by providing "services in the community, rather than institutions," the British Medical Journal reported.

Critics say the plan protects the profits of drug companies at the expense of the public.

The initiative began with Bush's launch in April 2002 of the New Freedom Commission on Mental Health, which conducted a "comprehensive study of the United States mental health service delivery system."

The panel found that "despite their prevalence, mental disorders often go undiagnosed" and recommended comprehensive mental health screening for "consumers of all ages," including preschool children.

The commission said, "Each year, young children are expelled from preschools and childcare facilities for severely disruptive behaviors and emotional disorders."

Schools, the panel concluded, are in a "key position" to screen the 52 million students and 6 million adults who work at the schools.

The commission recommended that the screening be linked with "treatment and supports," including "state-of-the-art treatments" using "specific medications for specific conditions."

The elder President Bush was a member of Lilly's board of directors and President Bush appointed Lilly's chief executive officer, Sidney Taurel, to the Homeland Security Council.

Of Lilly's $1.6 million in political contributions in 2000, 82 percent went to Bush and the Republican Party.

Another critic, Robert Whitaker, journalist and author of "Mad in America," told the British Medical Journal that while increased screening "may seem defensible," it could also be seen as "fishing for customers."

Exorbitant spending on new drugs "robs from other forms of care such as job training and shelter program," he said.

However, a developer of the Texas project, Dr. Graham Emslie, defends screening.

"There are good data showing that if you identify kids at an earlier age who are aggressive, you can intervene ... and change their trajectory."

Declaration of Independence Banned at Calif School

LOS ANGELES (Reuters) - A California teacher has been barred by his school from giving students documents from American history that refer to God -- including the Declaration of Independence.

Steven Williams, a fifth-grade teacher at Stevens Creek School in the San Francisco Bay area suburb of Cupertino, sued for discrimination on Monday, claiming he had been singled out for censorship by principal Patricia Vidmar because he is a Christian.

"It's a fact of American history that our founders were religious men, and to hide this fact from young fifth-graders in the name of political correctness is outrageous and shameful," said Williams' attorney, Terry Thompson.

"Williams wants to teach his students the true history of our country," he said. "There is nothing in the Establishment Clause (of the U.S. Constitution) that prohibits a teacher from showing students the Declaration of Independence."

Vidmar could not be reached for comment on the lawsuit, which was filed on Monday in U.S. District Court in San Jose and claims violations of Williams rights to free speech under the First Amendment.

Phyllis Vogel, assistant superintendent for Cupertino Unified School District, said the lawsuit had been forwarded to a staff attorney. She declined to comment further.

Williams asserts in the lawsuit that since May he has been required to submit all of his lesson plans and supplemental handouts to Vidmar for approval, and that the principal will not permit him to use any that contain references to God or Christianity.

Among the materials she has rejected, according to Williams, are excerpts from the Declaration of Independence, George Washington's journal, John Adams' diary, Samuel Adams' "The Rights of the Colonists" and William Penn's "The Frame of Government of Pennsylvania."

"He hands out a lot of material and perhaps 5 to 10 percent refers to God and Christianity because that's what the founders wrote," said Thompson, a lawyer for the Alliance Defense Fund, which advocates for religious freedom. "The principal seems to be systematically censoring material that refers to Christianity and it is pure discrimination."

In June, the U.S. Supreme Court refused to hear the case of a California atheist who wanted the words "under God" struck from the Pledge of Allegiance as recited by school children. The appeals court in California had found that the phrase amounted to a violation of church and state separation.

In the below federal discrimination lawsuit, filed Monday in U.S. District Court, Steven Williams contends that brass at Cupertino's Stevens Creek School have recently rejected his use of "curriculum-related handouts" like the Declaration, various state constitutions, George Washington's journal, John Adams's diary, and writings by William Penn. Williams alleges that the San Francisco-area school's principal, Patricia Vidmar, banned the use of these handouts because "many original source documents from the founding era contain references to God and Christianity." Williams alleges that Vidmar cracked down on his lesson plans in May, shortly after he distributed an example of a presidential proclamation. The document he chose was one issued by President George W. Bush dealing with a National Day of Prayer. Williams, who describes himself as an "orthodox Christian," states in his complaint that he "understands and admits that he is not permitted to 'proselytize' or seek to convert his students to Christian beliefs during instructional time." The Consequences Of Surrendering Liberty To Government Security

Recently it was reported that Senator Ted Kennedy was prevented from flying on commercial airlines because his name appeared on the federal government’s no-fly list. Now comes a report that another well-known American, commentator Cal Thomas, has also appeared on the no-fly list and consequently is harassed every time he attempts to board planes. For Thomas, that’s about a three-times-a-week occurrence.

Senator Kennedy had direct access to the private telephone number of Homeland Security Director, Tom Ridge, so that he could demand that his name be removed. Yet, even knowing the head man took the powerful Senator three weeks to get off the list. Cal Thomas doesn’t have such access, so like the rest of us, he suffers while trying to get uncaring, mindless, faceless federal bureaucrats to act and remove his name.

His story is a warning for what the rest of us face if Congress enacts National ID card legislation that is now on a fast track to passing as the result of massive pressure to fully implement the recommendations of the 9/11 Commission. Listen carefully, America. This is your future.

In his column detailing his experience being targeted for constant baggage inspections and body searches, Thomas tells of the horrors of dealing with a government behemoth like the Transportation Security Administration (TSA). “U.S. Airways gives me a TSA phone number to call,” writes Thomas. “I am not surprised when a machine answers. The machine promises a ‘prompt’ response. I leave a message. There is no response. A few days later, I call again. Same recording, same message, same non-response.” Thomas, a determined man who knows his way around government, keeps trying.

“I send an e-mail to the TSA. This time I receive an ‘automated reply,’ assuring me of a prompt response. Two days later, I receive another e-mail informing me I will have to fill out a form to prove I am not a terrorist.” Keep in mind, Cal Thomas, American, has had to endure all of this because the no-fly list is a front line strategy in the fight against terrorism.

It didn’t end there. Trying to take actions into his own hands, Thomas volunteered to sign up for the TSA’s “registered traveler” program, which is touted as a way for frequent flyers to get to the head of the security line. All travelers have to do says the propaganda is let the government record their “eye print” and fingerprints, and deposit the records into a federal database. Then, supposedly, the travelers can be quickly scanned and sent on their merry way. Cal Thomas found out the hard way that it just isn’t so.

It turns out that the scan is only good at the airport where he filed the application. So, even though he went through the trouble of registering with the national TSA databank at Dulles International Airport, when he tries to pass through the gates in Atlanta, he’s stopped as his name pops up again on the no-fly list. It seems he has to register for the “registered traveler” program at every airport from which he is flying. Meanwhile, he remains on the no-fly list marked as a possible terrorist threat. At last report, Cal Thomas was still waiting for a “prompt” response to his e-mails from the TSA.

This is not just a random experience. It is happening to thousands of “silent” Americans everyday. Americans who don’t have a national newspaper column to report it; Americans who don‘t have Tom Ridge’s personal phone number to demand satisfaction.

The truth of the situation is that government should never be entrusted with such power over our lives. It is amazing that all Americans, for example, stand in government lines such as the DMV waiting for bureaucrats to call their number, as we grumble about surly, inefficient bureaucrats. Yet every time a politician offers a new program which empowers the government with the ability to put us in even more lines to hand out tax paid goodies, we jump at the chance.

Take a look around you, America. Our nation is becoming less efficient, less productive, less secure and less educated than any time in our history. What is the common denominator in this equation? Government has gotten involved in more and more of our everyday routines.

Government cannot protect you from every danger. It cannot efficiently run airlines. It cannot create meaningful, productive jobs in the private sector. It cannot run efficient, affordable healthcare. It cannot effectively protect the environment. It cannot provide a quality food supply. It cannot adequately provide for you in your old age. It cannot create energy. It cannot provide a quality lifestyle. And it cannot stop the threat of terrorism by putting you in a government data bank and tracking your every move.

It can and will smother you with rules and regulations designed to perpetuate the growing power of government. That is what government does. Americans must learn that lesson or suffocate. Your papers, please.

No child left unmedicated

Big Brother is on the march. A plan to subject all children to mental health screening is under way, and pharmaceutical companies are gearing up for bigger sales of psychotropic drugs.

Like most liberal big-spending ideas, this one was slipped into the law under cover of soft semantics. Its genesis was the New Freedom Commission on Mental Health created by President George W. Bush in 2002.

The commission recommends "routine and comprehensive" testing and mental health screening for every child in the United States, including preschoolers. The president has instructed 25 federal agencies to develop a plan to implement the commission's recommendations.

The commission proposes using electronic medical records for mental health interrogation of both children and adults for mental illnesses in school and during routine physical exams. The commission also recommends integrating electronic health records and personal health information systems.

It recommends "linkage" of these mental examinations with "state-of-the-art treatments" using "specific medications for specific conditions." That means prescribing more expensive patented antidepressants and antipsychotic drugs.

Illinois became the first state to jump on board. By near-unanimous votes in 2003, the General Assembly passed the $10 million Illinois Children's Mental Health Act creating a Children's Mental Health Partnership, which is expected to become a model for other states. The partnership's plan, released July 16, calls for periodic social and emotional developmental examinations to be administered to all children, and for all women to be interrogated for depression during pregnancy and up to a year postpartum. When the partnership showcased this plan with five public hearings stacked with bureaucrats and social service workers, a political tempest erupted, with state legislators saying they had no idea this was what they had voted for.

Illinois legislators were shocked to hear the details. The plan includes periodic developmental exams for children ages 0-18 years, a statewide data-reporting system to track information on each child, social-emotional development screens with all mandated school exams in kindergarten, fourth grade and ninth grade, and report cards on children's social-emotional development.

The plan is to add mental health assessment to the state's physical examination certificate, along with mandatory immunization records. All children in Illinois, unless religiously exempt, are required to have up-to-date health examinations and immunizations for school entry.

The partnership requires the Illinois State Board of Education to develop and implement a plan that incorporates social and emotional standards as part of the mandated Illinois Learning Standards, which are due on Democratic Gov. Rod Blagojevich's desk by Dec. 31. This inevitably opens up screening for politically incorrect attitudes and nonconformity with liberal attitudes of tolerance.

Mental health diagnoses are inherently subjective and social constructions, as even the diagnostic manuals admit. Many thousands, if not millions, of children would receive stigmatizing diagnoses that would follow them for the rest of their lives.

"State-of-the-art treatments" will result in many thousands of children being medicated by expensive, ineffective, and dangerous drugs. The long-term safety and effectiveness of psychiatric medications on children have never been proven.

The side effects of suggested medications in children are severe. They include suicide, violence, psychosis, cardiac toxicity, and growth suppression. Several school shooters, such as Eric Harris (Columbine) and Kip Kinkel (Oregon) had been on antidepressants or stimulants when they committed their crimes.

The validity of much scientific research has lost its credibility because the Food and Drug Administration has allowed the pharmaceutical industry to withhold data not favorable to their products and because people in the pay of the pharmaceutical companies are the ones recommending medications.

The current controversy about links between suicide and antidepressant drugs that have not been adequately tested has contributed to the uproar. The FDA posted an analysis in August that some antidepressants pose a risk of suicide in children.

Parental rights are unclear or nonexistent under these mental screening programs. What are the rights of youth and parents to refuse or opt out of mental screening?

Will they face coercion and threats of removal from school, or child neglect charges, if they refuse privacy-invading interrogations or unproved medications? How will a child remove a stigmatizing label from his records?

A Columbia University pilot project of screening students called TeenScreen resulted in one-third being flagged as "positive" for mental health problems, and half of those being turned over for mental health treatment. If this is preview of what would happen when 52 million public school students are screened, it would mean hanging a libelous label on 17 million American children and putting 8 million children into the hands of the psychiatric/pharmaceutical industry.

I refuse to fly anymore. I refuse to be treated like a criminal. And I'm not the only one. Because of the treatment of passengers at our airports by the agents of the Transportation Security Administration, many Americans now refuse to fly if they can drive, or simply decide to stay home. This means fewer paying passengers on our airlines, fewer tourist dollars in vacation spots, and less revenue being generated for our airports and airline infrastructure.

I am one of those suspicious characters that every single time I fly, get "selected" for "special screening." I get to take off my shoes, spread my legs and arms to get "wanded" and then get patted down. When I ask why I was picked out of line, I was told that it was simply "random screening." The problem is that I "randomly" get selected every single time. A few months back I flew home from St. Louis after delivering a vehicle to a friend. When I went through the security gate I was pulled out, spread out, and "shoed." My shoes were then screened by a machine and an alarm went off showing nitrates. Immediately I was surrounded by four big guys in white shirts and scowls. "Do you deal in chemicals?" one asked. "Where would you pick up explosives on your shoes?" asked another. I said I don't deal in chemicals and I haven't used explosives in years (no sense of humor on their part at this last statement). "Oh, when did you use explosives?" asked one scowler.

"When I was in Vietnam, as a US Marine, killing every commie I could get in my sights!" was my first response, then "and when I was on the bomb disposal squad for the Tulsa Police Department" was my second.

They looked at each other, then one asked "so you're a cop?"

"I'm retired. I spent 26 years as a police officer."

"Do you have animals?"

"As a matter of fact, I have two horses, twelve chickens, two cats and a Labrador."

They all looked at each other, obviously relieved, and handed my shoes back. "Well, that explains it" said one. "Walking around animal dung puts nitrates on your shoes."

I couldn't help wondering about anyone in a city who walk streets inhabited by pigeons.

"Now, let ME ask YOU a question," says I. "Why did I get picked out--randomly?"

He showed me a checkered box at the bottom of my boarding pass and said that the computer does it, and when they see this they pull you out of line. I asked why I ALWAYS had the checkered box.

"Well, you could be on The List."

"What list?" I pursued.

"Let's put it this way. You might have ticked someone off in Washington, like the FBI or another agency. I can't say more. I'd get in trouble.You need to catch your plane." He half grinned and walked off. I headed for the gate.

It was then that I knew what it was all about. I had written my government-critical book "The Medusa File: Crimes and Coverups of the US Government", and in doing so stepped on a lot of toes. I knew the FBI had at one time tapped my phones, intercepted my mail, and tailed me--simply because I wrote about cases of government abuse, abuse of power and crimes committed by politicians and bureaucrats who used their posistions of power for their own agendas. And my treatment of exposing the truth on who was really involved in the Oklahoma City Bombing case and its connection to al Qaeda and Iraq--which was my last assigned case before I retired--really slammed a few criminals in high places. So now I was on The List. So be it.

Let me confess what kind of "criminal suspect" I am: I served in the US Marine Corps from 1964-1968, twelve months of which I was in Vietnam as a Marine infantryman, hunting Vietcong for Uncle Sam's Shooting Club. I was wounded in action and medevaced home. I was awarded six combat decorations including the Purple Heart, Combat Action Ribbon, Vietnam Cross of Gallantry, Vietnam Service Medal and Vietnam Campaign medal. I went on to serve later in the Army National Guard, as an NCO, then obtaining a comission as the oldest member of my OCS class. I rose through the ranks, eventually transferring ot the Army Reserve to serve as a company commander, battalion staff officer, and finally an intel officer. I retired in 1999 as a lieutenant colonel with 30 years total service. I am now also a 60% disabled vet due to combat wounds which have worsened over the years.

At the same time my day job was as a police officer. I served 26 years with the Tulsa PD, working uniform, plain clothes, SWAT, bomb squad and finally as a police helicopter pilot for 3600 hours of flight time. I received the department's Medal of Valor, two Chief's Medals, and the Department Commendation Medal. Not exactly the profile of a terrorist suspect, eh?

My sin, evidently, was using the First Amendment. By writing books that exposed government corruption I became a "suspicious character"--someone to add to The List.

9/11 was the biggest turning point in American legal history since the Kennedy Assassination. It was the driving force behind consolidation of federal law enforcement, creation of a new Homeland Defense Agency, and subsequent creation of the Transportation Security Administration. Three weeks after 9/11 I flew to Hawaii from Tulsa. The lines at the security gates were horrendous, the waits terrible, but I knew that once everything settled down in a few months, it had to get better. However, at the time it was very bad. When we began boarding in Los Angeles for Honolulu, I saw Pearl Harbor veterans wearing their survivor hats being pulled out of line for "special searches." These vets were in their 70s and 80s--most with canes and walkers. I asked one of the gate guards what was going on, and he said they were "random searches."

I said "then why don't you search the friggin' Arabs getting on the plane?" There were several middle-eastern types in line--none of which were given a glance.

"Because we are ordered not to racially profile."

"What? Gimme a break!" says I. "I was a cop for over two decades. We HAD to racially profile, as you say. After all, when the radio says that there's been an armed robbery by a black male in his 20s, we didn't go around looking for, or stopping a white lady in her sixties!"

He looked at me, shrugged his shoulders, and said "I know. But that's our orders from headquarters. We can get in trouble for pulling out Muslims and other people of middle eastern descent."

I was both shocked and disgusted. This whole thing went along with not closing off our southern border. How could you fight terrorism if you ignored the obvious and pursued the ridiculous?

Since then the TSA and our airport security system has developed into a more efficient system of screening as far as how long it takes to get through the gate. But so did Nazi Germany. There, the Geheimestatspolizei--commonly referred to as Gestapo--became extremely efficient. And feared. They had to answer to no one, could take anyone they wanted for interrogation, keep them as long as they wanted, and had to produce no laws or authority when asked. They could simply say "it's none of your business. We do what we want. We have to show you nothing!"

The TSA can do all of the above. Witness the case of Helen Chenoweth-Hage, a former Congresswoman (R-ID) from Idaho. She attempted to board a United Airlines flight in Boise and was pulled aside for additional screening. This included a pat down search and so on. She asked to see the regulation that authorizes the gate agents to conduct this and was told that she couldn't see it. She refused to go through additional screening unless they could produce the regulation, and she was not allowed to catch her plane. When asked later, the local TSA security director Julian Gonzales to the Idaho Statesman (10-10-04) that "She refused to go through additional screening and she was not allowed to fly." When asked why the TSA did not show her the regulation, he replied "because we don't have to."

This is known as Secret Law. They can pass it, but they don't have to show it to you. At the same time, "ignorance of the law is no excuse." You're damned if you do, and damned if you don't.

As a career police officer, and a counter-terrorist specialist trained by the US Army, I can't help but wonder what in the world is going on here. Terrorism is not being effectively addressed by such antics. Treating average Americans, including women and babies, like criminals does little to stem dedicated terrorists. It is like when I was in Vietnam, being ordered to detain and search other Marines and leave the Vietcong alone because we didn't want to offend them.

Is there some secret conspiracy in the works that has the objective of motivating people not to travel? In Russia, as a form of control of the population, they issued internal passports to discourage traveling outside your own "home area." Here, dealing with Americans, it is done with suggestive mind control. Make it so complicated, so annoying, so embarrasing, that no one WANTS to travel. It accomplishes the same thing.

Dont' worry about the airlines. They will go broke until there are only a few left, all subsidized and totally controlled by the government--like Lufthansa and el Al. We'll be told it was because of unions, or rising fuel costs, or other excuses, when in fact it will be because people will no longer wish to fly unless they have to.

But, Citizen, remember: when you get to the airport, have your papers in order and be ready to be searched. And don't try any humor when being searched by saying something like "you missed a spot--can you get between my shoulder blades a little to the left...?" The Airport Nazis have NO sense of humor.

Today's air travel requirements remind me of an old black-and-white World War II movie wherein a Gestapo agent at a train station approaches our hero and asks "You haf papers? You haf permit to be on Reich soil?"

I think I'll just drive from now on.

SSRIs Can Provoke Abnormal Bleeding

Patients who take a popular form of antidepressants are at risk of abnormal bleeding, according to a new study. The drugs, known as selective serotonin reuptake inhibitors, or SSRIs, interfere with clotting and can provoke bleeding in the stomach, the vagina and even the brain, researchers found.

The research, published in this week's edition of the Archives of Internal Medicine, noted that, ironically, the better the drugs work, the greater the risk of bleeding.

SSRIs include fluoxetine (sold under the brand name Prozac) and paroxetine (Paxil). They work by stimulating production of the brain chemical serotonin, which is believed to regulate depression and anxiety. But serotonin also helps regulate blood clotting.

"We found a significant association between [the] degree of serotonin-reuptake inhibition by antidepressants, and risk of hospital admission for abnormal bleeding," said Welmoed Meijer, a pharmacoepidemiologist at the Utrecht Institute for Pharmaceutical Sciences in the Netherlands.

The study was conducted o a group of 64,000 antidepressant users between 1992 and 2000. Individuals were classified according to the degree (high, intermediate, or low) of serotonin-reuptake inhibition of the antidepressants they were taking.

Among study participants, there were 196 cases of abnormal bleeding -- including abnormal uterus bleeding and gastrointestinal bleeding.

"We found a significant association between degree of serotonin reuptake inhibition by antidepressants and risk of hospital admission for abnormal bleeding," the researchers wrote.

Dr. Meijer said that while very few patients actually experienced the side effects, it is significant that patients who took SSRIs were three times more likely to suffer from bleeding than those who took other kinds of antidepressants.

He said bleeding incidents were far more severe in people taking non-steroidal anti-inflammatory drugs, which range from over-the-counter products such as acetylsalicylic acid (Aspirin), ibuprofen (Advil, Motrin) prescription drugs such as rofecoxib (Vioxx) and celecoxib (Celebrex), because those commonly used drugs also affect clotting.

Dr. Meijer said the study almost certainly underestimated bleeding because it looked only at hospital admissions. The practical information physicians and consumers should retain, he said, is that SSRIs may not be appropriate for some people, particularly those who have blood disorders such as hemophilia or anemia, those who have ulcers, and women who suffer from heavy menstrual bleeding.

SSRIs have been in the news of late because of reports that use of the antidepressants may actually increase the risk of suicide, particularly among children and adolescents.

Health Canada has warned that pregnant women should avoid taking a broad range of antidepressants, including SSRIs. It also cautioned that children and adolescents taking SSRIs should be monitored, particularly for suicidal thoughts.

According to IMS Canada, a company that tracks prescription-drug trends, there were 15.7 million prescriptions last year for SSRIs. Sales topped $990-million in 2003. Paxil alone has sales of more than $280-million a year.

Going to school can be dangerous for your child's health, especially for boys since they are the targets of this medical campaign.

Anti-Schwarzenegger Website Gets Support

A week after a group set up a website to oppose changing the U.S. Constitution to allow Arnold Schwarzenegger to become president, more than 3 million people have visited the site, and more than $10,000 have been pledged to the campaign.

The money will go toward a campaign by nationally syndicated radio talk-show host Alex Jones and his group Americans Against Arnold to air commercials on radio and cable television to rally opposition to the proposed legislation.

Jones, who lives in Austin, Texas, hopes to put the cable ads on television in California to counter commercials supporting a constitutional change that would allow foreign-born citizens, including Schwarzenegger, to seek the highest office in the country.

"I personally am against a foreign-born person being president," said Jones, a former Republican who is now a Libertarian. "People want their president to be born in this country."

He is also troubled by Schwarzenegger's past, which includes allegations that he groped women, used steroids and schemed about his eventual rise to power. "The guy has all of the classic symptoms of a megalomaniac," Jones said.

A Schwarzenegger spokesman declined to comment.

But Schwarzenegger supporters have sent e-mails to the anti-Arnold site to warn that they are messing with the wrong man.

Said one e-mail: "He will smash you like the girlie men you are."

A Brief Analysis of the Domestic Security Enhancement Act 2003
- Also Known as USA Patriot Act II

Congressman Ron Paul (R-Tex) told the Washington Times that no member of Congress was allowed to read the first Patriot Act that was passed by the House on October 27, 2001. The first Patriot Act was universally decried by civil libertarians and Constitutional scholars from across the political spectrum. William Safire, while writing for the New York Times, described the first Patriot Act's powers by saying that President Bush was "seizing dictatorial control." On February 7, 2003 the Center for Public Integrity, a non-partisan public interest think-tank in DC, revealed the full text of the Domestic Security Enhancement Act of 2003. The classified document had been leaked to them by an unnamed source inside the Federal government. The document consisted of a 33 page section by section analysis of the accompanying 87 page bill.

The bill itself is stamped "Confidential - Not for Distribution." Upon reading the analysis and bill, I was stunned by the scientifically crafted tyranny contained in the legislation. The Justice Department Office of Legislative Affairs admits that they had indeed covertly transmitted a copy of the legislation to Speaker of the House Dennis Hastert, (R-Il) and the Vice President of the United States, Dick Cheney as well as the executive heads of federal law enforcement agencies.

It is important to note that no member of Congress was allowed to see the first Patriot Act before its passage, and that no debate was tolerate by the House and Senate leadership. The intentions of the White House and Speaker Hastert concerning Patriot Act II appear to be a carbon copy replay of the events that led to the unprecedented passage of the first Patriot Act.

There are two glaring areas that need to be looked at concerning this new legislation:

1. The secretive tactics being used by the White House and Speaker Hastert to keep even the existence of this legislation secret would be more at home in Communist China than in the United States. The fact that Dick Cheney publicly managed the steamroller passage of the first Patriot Act, ensuring that no one was allowed to read it and publicly threatening members of Congress that if they didn't vote in favor of it that they would be blamed for the next terrorist attack, is by the White House's own definition terrorism. The move to clandestinely craft and then bully passage of any legislation by the Executive Branch is clearly an impeachable offense.

2. The second Patriot Act is a mirror image of powers that Julius Caesar and Adolf Hitler gave themselves. Whereas the First Patriot Act only gutted the First, Third, Fourth and Fifth Amendments, and seriously damaged the Seventh and the Tenth, the Second Patriot Act reorganizes the entire Federal government as well as many areas of state government under the dictatorial control of the Justice Department, the Office of Homeland Security and the FEMA NORTHCOM military command. The Domestic Security Enhancement Act 2003, also known as the Second Patriot Act is by its very structure the definition of dictatorship.

I challenge all Americans to study the new Patriot Act and to compare it to the Constitution, Bill of Rights and Declaration of Independence. Ninety percent of the act has nothing to do with terrorism and is instead a giant Federal power-grab with tentacles reaching into every facet of our society. It strips American citizens of all of their rights and grants the government and its private agents total immunity. Here is a quick thumbnail sketch of just some of the draconian measures encapsulated within this tyrannical legislation:

SECTION 501 (Expatriation of Terrorists) expands the Bush administration's "enemy combatant" definition to all American citizens who "may" have violated any provision of Section 802 of the first Patriot Act. (Section 802 is the new definition of domestic terrorism, and the definition is "any action that endangers human life that is a violation of any Federal or State law.") Section 501 of the second Patriot Act directly connects to Section 125 of the same act. The Justice Department boldly claims that the incredibly broad Section 802 of the First USA Patriot Act isn't broad enough and that a new, unlimited definition of terrorism is needed.

Under Section 501 a US citizen engaging in lawful activities can be grabbed off the street and thrown into a van never to be seen again. The Justice Department states that they can do this because the person "had inferred from conduct" that they were not a US citizen. Remember Section 802 of the First USA Patriot Act states that any violation of Federal or State law can result in the "enemy combatant" terrorist designation.

SECTION 201 of the second Patriot Act makes it a criminal act for any member of the government or any citizen to release any information concerning the incarceration or whereabouts of detainees. It also states that law enforcement does not even have to tell the press who they have arrested and they never have to release the names.

SECTION 301 and 306 (Terrorist Identification Database) set up a national database of "suspected terrorists" and radically expand the database to include anyone associated with suspected terrorist groups and anyone involved in crimes or having supported any group designated as "terrorist." These sections also set up a national DNA database for anyone on probation or who has been on probation for any crime, and orders State governments to collect the DNA for the Federal government.

SECTION 312 gives immunity to law enforcement engaging in spying operations against the American people and would place substantial restrictions on court injunctions against Federal violations of civil rights across the board.

SECTION 101 will designate individual terrorists as foreign powers and again strip them of all rights under the "enemy combatant" designation.

SECTION 102 states clearly that any information gathering, regardless of whether or not those activities are illegal, can be considered to be clandestine intelligence activities for a foreign power. This makes news gathering illegal.

SECTION 103 allows the Federal government to use wartime martial law powers domestically and internationally without Congress declaring that a state of war exists.

SECTION 106 is bone-chilling in its straightforwardness. It states that broad general warrants by the secret FSIA court (a panel of secret judges set up in a star chamber system that convenes in an undisclosed location) granted under the first Patriot Act are not good enough. It states that government agents must be given immunity for carrying out searches with no prior court approval. This section throws out the entire Fourth Amendment against unreasonable searches and seizures.

SECTION 109 allows secret star chamber courts to issue contempt charges against any individual or corporation who refuses to incriminate themselves or others. This sections annihilate the last vestiges of the Fifth Amendment.

SECTION 110 restates that key police state clauses in the first Patriot Act were not sunsetted and removes the five year sunset clause from other subsections of the first Patriot Act. After all, the media has told us: "This is the New America. Get used to it. This is forever."

SECTION 111 expands the definition of the "enemy combatant" designation.

SECTION 122 restates the government's newly announced power of "surveillance without a court order."

SECTION 123 restates that the government no longer needs warrants and that the investigations can be a giant dragnet-style sweep described in press reports about the Total Information Awareness Network. One passage reads, "thus the focus of domestic surveillance may be less precise than that directed against more conventional types of crime."

*Note: Over and over again, in subsection after subsection, the second Patriot Act states that its new Soviet-type powers will be used to fight international terrorism, domestic terrorism and other types of crimes. Of course the government has already announced in Section 802 of the first USA Patriot act that any crime is considered domestic terrorism.

SECTION 126 grants the government the right to mine the entire spectrum of public and private sector information from bank records to educational and medical records. This is the enacting law to allow ECHELON and the Total Information Awareness Network to break down any and all walls of privacy. The government states that they must look at everything to "determine" if individuals or groups might have a connection to terrorist groups. As you can now see, you are guilty until proven innocent.

SECTION 127 allows the government to takeover coroners' and medical examiners' operations whenever they see fit. See how this is like Bill Clinton's special medical examiner he had in Arkansas that ruled that people had committed suicide when their arms and legs had been cut off.

SECTION 128 allows the Federal government to place gag orders on Federal and State Grand Juries and to take over the proceedings. It also disallows individuals or organizations to even try to quash a Federal subpoena. So now defending yourself will be a terrorist action.

SECTION 129 destroys any remaining whistle blower protection for Federal agents.

SECTION 202 allows corporations to keep secret their activities with toxic biological, chemical or radiological materials.

SECTION 205 allows top Federal officials to keep all their financial dealings secret, and anyone investigating them can be considered a terrorist. This should be very useful for Dick Cheney to stop anyone investigating Haliburton.

SECTION 303 sets up national DNA database of suspected terrorists. The database will also be used to "stop other unlawful activities." It will share the information with state, local and foreign agencies for the same purposes.

SECTION 311 federalizes your local police department in the area of information sharing.

SECTION 313 provides liability protection for businesses, especially big businesses that spy on their customers for Homeland Security, violating their privacy agreements. It goes on to say that these are all preventative measures - has anyone seen Minority Report? This is the access hub for the Total Information Awareness Network.

SECTION 321 authorizes foreign governments to spy on the American people and to share information with foreign governments.

SECTION 322 removes Congress from the extradition process and allows officers of the Homeland Security complex to extradite American citizens anywhere they wish. It also allows Homeland Security to secretly take individuals out of foreign countries.

SECTION 402 is titled "Providing Material Support to Terrorism." The section reads that there is no requirement to show that the individual even had the intent to aid terrorists.

SECTION 403 expands the definition of weapons of mass destruction to include any activity that affects interstate or foreign commerce.

SECTION 404 makes it a crime for a terrorist or "other criminals" to use encryption in the commission of a crime.

SECTION 408 creates "lifetime parole" (basically, slavery) for a whole host of crimes.

SECTION 410 creates no statute of limitations for anyone that engages in terrorist actions or supports terrorists. Remember: any crime is now considered terrorism under the first Patriot Act.

SECTION 411 expands crimes that are punishable by death. Again, they point to Section 802 of the first Patriot Act and state that any terrorist act or support of terrorist act can result in the death penalty.

SECTION 421 increases penalties for terrorist financing. This section states that any type of financial activity connected to terrorism will result to time in prison and $10-50,000 fines per violation.

SECTION 427 sets up asset forfeiture provisions for anyone engaging in terrorist activities. There are many other sections that I did not cover in the interest of time. Oregon Law Would Jail War Protesters as Terrorists

PORTLAND, Oregon (Reuters) - An Oregon anti-terrorism bill would jail street-blocking protesters for at least 25 years in a thinly veiled effort to discourage anti-war demonstrations, critics say.

The bill has met strong opposition but lawmakers still expect a debate on the definition of terrorism and the value of free speech before a vote by the state senate judiciary committee, whose Chairman, Republican Senator John Minnis, wrote the proposed legislation.

Dubbed Senate Bill 742, it identifies a terrorist as a person who "plans or participates in an act that is intended, by at least one of its participants, to disrupt" business, transportation, schools, government, or free assembly.

The bill's few public supporters say police need stronger laws to break up protests that have created havoc in cities like Portland, where thousands of people have marched and demonstrated against war in Iraq since last fall.

"We need some additional tools to control protests that shut down the city," said Lars Larson, a conservative radio talk show host who has aggressively stumped for the bill.

Larson said protesters should be protected by free speech laws, but not given free reign to hold up ambulances or frighten people out of their daily routines, adding that police and the court system could be trusted to see the difference.

"Right now a group of people can get together and go downtown and block a freeway," Larson said. "You need a tool to deal with that."

The bill contains automatic sentences of 25 years to life for the crime of terrorism.

Critics of the bill say its language is so vague it erodes basic freedoms in the name of fighting terrorism under an extremely broad definition.

"Under the original version (terrorism) meant essentially a food fight," said Andrea Meyer of the American Civil Liberties Union (ACLU), which opposes the bill.

Police unions and minority groups also oppose the bill for fear it could have a chilling effect on relations between police and poor people, minorities, children and "vulnerable" populations.

Legislators say the bill stands little chance of passage.

"I just don't think this bill is ever going to get out of committee," said Democratic Senator Vicki Walker, one of four members on the six-person panel who have said they oppose the legislation.

By 'Non-Lethal' Tasers

No one seems to ever speak of this, yet this so-called "non-lethal" device has killed a number of people. It's time to look at the real electrical details of a Taser , and how it compares to known electrical effects on the human body.

Some believe a taser is all about high voltage and no current. A big lie and far from the truth. This only applies to static electricity, when no capacitor is used. Tasers are also about current (amperage.) A current of 20 milliamps (. 020 amps) or more is known to fatally stop the human heart. Any voltage above 50 volts (such as a phone line) will be felt as a tingle (or even worse.) The electric chair uses 2,300 volts.

The 90 volts AC that rings your telephone WILL HURT if you have your fingers across the two wires when the phone rings. Remember that telephone ringing voltage is just 30 volts less than your wall outlet has. 50,000 volts from a Taser is FAR MORE HARMFUL, especially because the Taser darts penetrate the skin, and connect to Taser's high voltage transformer to the internal, highly conductive wet saline (salt) environment of the human body.

In electrical engineering, any voltage over 48 volts is not considered safe low voltage. Low voltage electrical code exempt wiring is similar to that used for your stereo speakers, and on small DC power packs used to replace batteries to power radios, tape players, CDs etc... Any voltage higher than 48V (telephone lines) must be wired much like house wire, with proper grounding and junction boxes. This is the national electrical code.

Tasers output 50,000+ VOLTS. Even if a Taser's current less than 20 milliamps, it may not matter if the person has a WEAK HEART. A much lower current could still cause cardiac arrest. Autopsies have proven THIS IS TRUE (see below.) But no manufacturer ever talks about this. So let's look at how the "non-lethal" 50,000 VOLTS IS in a few cases below. Remember these are some of the cases that made it to the media, or were correctly identified as the cause DURING AN AUTOPSY performed shortly after death:

So as you can see above, the Taser is a harmless, non-lethal weapon. It's a comfort to know that our police state enforcers use weapons that can't kill you as quick as a bullet in the head. So what's wrong with 50,000 volts across your heart ? Why do you think you heart beats are based on ELECTRICAL activity ? Just because doctors connect up WIRES to stick-on electrodes on your chest to do an electrocardiogram - you think your heart is based on electrical activity ? The electrocardiogram machine measures voltages of just a .001 volts (ONE THOUSANDTH OF A VOLT) to detect a human heart beat. So why would you think that 50,000 VOLTS will hurt you ?

About 160 volts is used to START the heart to bring a life back, and a lesser voltage is used to STOP the heart in hospital operating rooms on an exposed heart during open heart surgery. So why would you think a voltage more than 300 times that from a Taser hurt you ? The manufacturers of these devices tell us Tasers are harmless, and thus it must be so.

Enough rhetoric. SINCE THIS DEVICE IS INVASIVE AND NOT INTENDED TO KILL LIKE A BULLET - BY LAW THE FDA SHOULD BE DISAPPROVING THE USE OF THESE FATAL, NON-LETHAL WEAPONS BECAUSE THEY BREAK THE SKIN, AND HAVE A RISK OF INFECTION, AND CAN/DO INTERFERE WITH CRITICAL BODILY ELECTRICAL ACTIVITY.

DISEASES

So, if your heart survives the high voltage shock - what about an infection from having two metal darts penetrate your skin and connect to your body's blood circulation system ? Is that healthy, too ? Any common pathogens on anyone's skin (and on the dart tips that might have come out of the dirty trunk of a police car or someone's side holster) such as staph, bacteria, prions, viruses (like HIV,) mycoplasmas, or MRSA will be INJECTED into your bloodstream by the two darts. It only takes a fraction of a second for this infection to be inoculated into YOUR bloodstream. The high voltage shock will increase your heart beat and help to spread the infection faster. There doesn't appear to be any data on this at all, yet it's almost a certainty and infection can occur based on well known medical science.

Look at the pathetic weak excuses given in the few known case histories shown above. Simple, harmless behavioral problems can bring on a Taser punishment session from one of the police state thugs.

Maria Shriver: Schwarzenegger Won't Be President

LOS ANGELES (Reuters) - California Gov. Arnold Schwarzenegger's wife, Maria Shriver, says America may someday amend the U.S. Constitution and elect a foreign-born president -- but it won't be her husband.

"Forget about it. It is not going to happen. The process takes years, and this is as far as it goes," Shriver, the niece of former President John F. Kennedy, told Vanity Fair magazine amid talk of amending the Constitution to allow the Austrian-born film star to run for president.

Shriver also said that despite their political differences -- she is a Democrat, he a Republican -- their marriage was strong and passionate.

"(We're) still engaged with each other, hot for each other, into each other," she said. "There hasn't been a moment when I have been bored. I have worked and worked on my marriage, and it has paid off."

Shriver admitted that stories before Schwarzenegger's election as governor in 2003 about his womanizing were "flat-out tough, painful, no doubt about it."

When interviewer Marie Brenner asked whether a part of her wondered if the stories could be true, Shriver said: "You have to know the person in front of you. You have to be able to separate what your reality is, what other people's perceptions are. .... You have to go on with your life."

Asked how she coped, Shriver said, "I fight. ... You have to struggle in every aspect of your life."

A member of America's most famous political family, the Kennedys, Shriver said that in marrying Schwarzenegger she needed to defy expectations and was glad she did.

"Everyone assumed that I was supposed to marry someone like a John Kerry, some preppy that had gone to Harvard or Yale," she said. "I didn't want to marry those boys. I did not like them. I had been around them my whole life. I interrupted the story line. I wanted out of that suffocation. I wanted someone different. I married my authentic self."

Schwarzenegger told Vanity Fair he understood his wife's need to break away, calling the Shriver family "the clones."

"Everyone in the family thinks exactly the same," he said. "If her mother says it is green, it is green. If her father says it is black, it is black. When you are in the family, you think this is normal, and then you meet someone from the outside and the lights go on. Here was a guy who was free.... If he wants to be a Republican, he is a Republican. If he wants to be a movie star, he is a movie star."

Years ago, when I was in the Army, I got stuck in a typing pool. I typed a memo for a captain that contained several erasures. When I gave it to him, he said: "That's pretty (expletive) typing, Private. I hope you don't have to make a living at it."

I said nothing, but I watched him, and when he put another handwritten memo into the box, I grabbed it. I typed it perfectly and then walked over to his desk with the typed copy and his original.

"That's pretty (same expletive) handwriting, sir. I hope your livelihood doesn't depend on anybody being able to read it."

His jaw dropped, but he didn't say anything. Captains are not used to being talked to that way by privates. The beauty of being a private, however, is that there is very little the Army can do to you that it is not already doing.

I recount that anecdote from my checkered past to tell you that free speech is meaningless if you don't use it. If being an American means anything, it means that you don't have to tolerate personal insults from anybody under any circumstances. At least that's the way we are taught in the South.

When Lithuania was still part of the Soviet Union, a little girl came home crying. She told her mother that her teacher had stood her up in front of the class and ridiculed her Christian beliefs. Now, this mother was in a totally powerless position. She lived in a dictatorship. The government could do anything it wanted to do with her, and she would be defenseless.

Nevertheless, this brave lady marched down to the local Communist Party headquarters and gave the people there verbal hell. Many, many men and women who live under tyranny nevertheless demonstrate great courage.

Some Russians believe that Alexander Solzhenitsyn did as much as anyone to bring down the Soviet Union. His books about the gulag ripped the façade off the Soviet Union so that not even American liberals could deny anymore what an evil tyranny it was.

After being released from prison, Solzhenitsyn was ordered not to attend the funeral of another Soviet dissident. The great man not only attended the funeral, but he marched up to the casket and kissed the forehead of the dead man. Even though he lived in the one of the world's worst tyrannies, Solzhenitsyn always acted like a free man.

There are good Americans who show the same kind of courage. In one Central Florida elementary school, the children were told they could bring holiday cards to exchange with their classmates. One little girl affixed stickers to her cards that said "Jesus loves you." When the teacher saw this, she ordered the little girl to take back all of her cards. The child was humiliated.

An attorney friend of mine heard about this, contacted the parents and then informed the school board that it owed the little girl a public apology. The school-board attorney said: "You'll never get it. I can tie you up in court, and it will cost you $30,000."

"Well," my friend said, "I just happen to have $30,000, and if that's what it takes, so be it, but the board is going to give this child a public apology." And that's exactly what happened, because one man decided he would not tolerate an injustice. He didn't charge the girl's family a penny.

The government would like us all to spy on our neighbors to detect terrorists. What we really should do is keep our eyes open for injustices, and when we find them, we should speak out.

Many people in this country are powerless. They don't have much money. They don't have influential friends. And quite often, because they are powerless, they suffer injustice. What a wonderful country this would be if the powerless knew they were not alone, if they knew that there are other Americans willing to use their voices and their resources to protect them from injustice.

Freedom is a wonderful thing if used properly, but wasting freedom on selfish pursuits is probably a sin God will have a hard time forgiving.

COLLEGE STATION, Texas -- Former President George H.W. Bush presented Gov. Arnold Schwarzenegger an award for public service on Tuesday and suggested that the foreign-born, former action movie star could someday be elected president.

"In regard to him ever being president of the United States, my advice to you Aggies and to any of those doubters, don't bet against Arnold Schwarzenegger," Bush told about 2,500 people attending the award ceremony at Texas A&M University.

The former president didn't endorse Schwarzenegger for the nation's highest office. But he obliquely referred to recent discussions about amending the U.S. Constitution to allow a foreign-born citizen to be president. Schwarzenegger, who was born in Austria, currently is ineligible for the White House, but Bush said people have been underestimating him during his entire career -- as a bodybuilder, actor and now governor.

Schwarzenegger tried to downplay the presidential speculation about himself, but he said immigrants should have the opportunity to run for the office.

"I like the opportunity," he replied, eliciting much laughter, when an immigrant-questioner in the audience said he didn't believe immigrants should be president.

"Of course, not because of me. I only have an interest to fix California," the governor added. "But I think that if someone lives here a period of time ... and votes and all that and makes good contributions to the country, I think someone should have the right to also run for president."

He called the debate over a constitutional amendment a "very interesting discussion, and I hope the discussion will go on in the future in this country."

A Silicon Valley group has launched a Web site and sponsored TV commercials promoting a constitutional amendment that would benefit a Schwarzenegger presidential bid. The governor has tried to distance himself from the group. But he has been traveling extensively outside of California and, according to one newspaper report, organizers of the "Amend for Arnold" movement say he has privately given them encouragement.

Schwarzenegger campaigned for President George W. Bush during this fall's White House race. He also campaigned for former President Bush and chaired his Council on Physical Fitness and Sports.

Schwarzenegger said the former president wrote him a letter encouraging him to run for California governor a year ago, when the former actor unseated Democrat Gray Davis in a recall election. Despite lingering budgetary problems, Schwarzenegger remains hugely popular in the state.

The former president presented Schwarzenegger the 2004 George Bush Award for "excellence in public service" and praised the governor for his dreams and his perseverance.

"Arnold is not afraid to dream big, and he's put in the hard work to make that dream into a reality," Bush said.

"He's embraced the idea of public service as a noble calling," he added.

Previous recipients of the award include former Soviet leader Mikhail Gorbachev, former German Chancellor Helmut Kohl and U.S. Sen. Ted Kennedy, D-Mass., the uncle of Schwarzenegger's wife, Maria Shriver.

The governor joked that Kennedy wanted to attend Tuesday's ceremony but couldn't.

"Thanksgiving was only five days ago, and he's still working on his dinner," Schwarzenegger quipped.

The honoree also joked that the award was a "presidential pardon for my bad movies."

The governor praised the former president for his career of public service.

He said Bush was "not only my hero but he's also my mentor and my teacher."

A constitutional amendment allowing Schwarzenegger or any other foreign-born citizen to run for president would require a two-thirds vote of both houses of Congress and ratification by 38 states.

And when we publish, we do it in a timely fashion. Better, I say, to be surprised by your newspaper in October than to learn in November that your newspaper has betrayed you by withholding the truth.

The lavish coverage is perpetual and is, in reality, nothing more than the launch of his Presidential campaign by the establishment media.

The TV news outlets, however, that we have contacted simply tell us "they'll get back with us." Then, the next day, we see Morgenthaler-Jones of the terminate-the Constitution crowd on their show.

Depending on what national poll you look at, eighty to sixty percent of Americans are against amending the Constitution for Schwarzenegger or anyone else. Why, then, won't the media cover what we're doing?

Maria Schriver is playing her usual role of defense in telling Vanity Fair that she's sure the Constitution will be changed for a foreigner, but it won't be Arnold . This is just like when she said Arnold would not run for governor. Her transparent cover allows Arnold to continue running his Presidential campaign while denying it doesn't exist.

We warned you, he's not playing games. While in Texas getting his award from George H. W. Bush he then went on to a fundraiser to get $20,000 a plate for some unnamed campaign.

Special Interests buy their way into the Schwarzenegger Administration

According to an LA Times analysis, Arnold's staff has accepted hundreds of gifts worth tens of thousands of dollars from special interests. These gifts ranged from 152 lunches to $7,818 in Kings tickets to a trip to the circus for Arnold's PR chief's family. [Note #1 to PR team: taking special interest perks is not good PR for the gov who said he'd get rid of the special interests.] (A full database of the gifts is available at http://www.latimes.com/lobbygifts ).

Now that Arnold has announced a delegation of special interests -- led by Chamber of Commerce chief Allan Zaremberg -- which will join him on his upcoming trip to Japan, we can only imagine what goodies might be showered on the gov's staff from the corporations on this trip. A Samurai Sword from Sunkist. A day at the Dojo from Disney. Yakitori from United.

The point is Arnold should never have let this special interest gift giving get out of hand as it has. The interests are wining and dining his administration and will continue to because they know their generosity will be repaid when decisions are made.

If Schwarzenegger really wanted to cut special interests out of Sacramento, the Gov would have brought down the hatchet on his legislative secretary (who took two dozen special interest gifts) and the rest of Team Arnold that raked in $44K worth of special treatment from special interests. Instead, Arnold's spokeswoman Margita Thompson told the Times that the outings -- like her family's free ride to Disneyland -- "affords you an opportunity in an informal setting to develop a rapport and build on a relationship." She then added that it would be unfair to make administration officials with salaries over $100K pay for their own iPods or family trips to Sea World. [Note #2: saying high paid staffers deserve free stuff makes the gov look out of touch.]

In Arnold's "I'm no Gray Davis" administration, why would these special interests even try to buy their way into the Gov's inner sanctum? "It just makes good sense," said California's largest land developer; "having a relationship allows you to be higher on [government officials'] calendar," said ChevronTexaco's lobbyist. The largess, says a British Petroleum flak, "allows us to have, in a relaxed setting, the ability to meet those people who are involved in. . . all the government decisions that affect our business."

The reason these interests want to be higher on the calendar is because they have big money issues before the administration. ChevronTexaco aims for support from Arnold & Co. on plans to bring Liquefied Natural Gas into California, for example. SBC, which wants to shape Arnold's appointments to the Public Utilities Commission, gave Kings Tickets to the Gov's Appointments Secretary.

For some clarity on the need to avoid too much coziness with the special interests, Gray Davis himself chimed in and counseled from experience: "over time you feel the need to reciprocate. It's human nature." Arnold needing Gray for ethics advice, who could have guessed?

Should the Constitution be amended for Arnold?

LOS ANGELES — Abolishing slavery. Giving women the vote. Establishing the income tax. Limiting presidents to two terms. Through more than two centuries, it usually has taken a weighty cause to survive the burdensome process of amending the U.S. Constitution. Americans hold the work of the Founding Fathers in such reverence that they've added to it only 17 times since 1791. That's when the first 10 amendments were codified as the Bill of Rights.

Now, debate over a proposed 28th Amendment is focused on the popularity and political future of one man: macho Republican Arnold Schwarzenegger, the former bodybuilder and action-movie star who has been California's governor for barely a year.

With a bit of encouragement from the Terminator himself, some of Schwarzenegger's supporters are pushing for a constitutional amendment that would allow the Austrian-born governor to run for the White House as soon as 2008. Schwarzenegger is blocked by Article 2, Section 1, Clause 5 of the Constitution. It reads, "No person except a natural born citizen ... shall be eligible to the office of president." The 12th Amendment says the vice president cannot be foreign-born.

Could America's infatuation with Schwarzenegger lead to passage of a constitutional amendment that would drop those bans — an idea that has died in Congress more than two dozen times since the 1870s? Probably not, but Schwarzenegger's rise in politics has led members of Congress and a few of the governor's wealthy California donors to launch a long-shot campaign that they have cast as an effort to guarantee equal rights for millions of foreign-born Americans.

If the movement gains significant momentum, it might create some interesting political scenarios. It could become a test of American attitudes toward immigrants in the post-9/11 era, and put a spotlight on the depth of conservative Republicans' feelings about Schwarzenegger, who supports abortion rights and gay civil unions.

The bar to the nation's highest offices is the only formal restriction on the rights of the USA's 12.8 million foreign-born, naturalized citizens, who are among the 34 million U.S. residents born abroad. Every year, 450,000 immigrants are naturalized, including 25,000 children adopted by citizens.

Proponents of change note that 700 immigrants in uniform have been awarded the Medal of Honor since the Civil War, and that 60,000 now serve in the military.

Sen. Orrin Hatch, R-Utah, a political ally of Schwarzenegger, introduced the Equal Right to Govern Amendment in July 2003, a few weeks before the actor declared his candidacy in the recall election in which Californians ousted Democrat Gray Davis as governor.

If Hatch's amendment is adopted, an immigrant who has been a naturalized citizen for 20 years could run for president or vice president.

Schwarzenegger, 57, has been a U.S. citizen since 1983. He has retained Austrian citizenship.

Hatch's resolution must withstand daunting tests for proposed amendments: approval by two-thirds majorities in both houses of Congress, followed by ratification by three-quarters of the states — 38 of them.

As the departing chairman of the Senate Judiciary Committee, Hatch boosted the amendment with favorable testimony from academics and legislators at a public hearing Oct. 5. Sen. Arlen Specter, R-Pa., who will head the committee in the congressional session that begins in January, says he hasn't made up his mind on the issue but will put it on the panel's agenda.

Few proposed constitutional amendments have fared well recently. The Equal Rights Amendment, which took aim at gender discrimination, died in 1982 after 35 states had ratified it. Amendments to ban burning the U.S. flag and gay marriage have died in Congress. The gay-marriage measure might be revived next year.

Despite Schwarzenegger's wealth, fame and 65% voter approval rating in California, "it's the longest shot in a life full of long shots" for him, says Lissa Morgenthaler-Jones, 47, a Silicon Valley businesswoman and Schwarzenegger campaign donor.

With her husband and a friend, Morgenthaler-Jones started the Web site www.amendforarnold.org in August to rally support for an amendment. The group paid $20,000 to run a TV ad in California over six days in November.

"You cannot choose the land of your birth," Morgenthaler-Jones says in the ad. "You can choose the land you love."

Schwarzenegger has said in interviews that he supports an amendment. So does his wife, Maria Shriver. But California's first lady says in the January issue of Vanity Fair, published Wednesday, that she doesn't expect much from the campaign on her husband's behalf. (Story: Shriver supports amendment)

"Forget about it," she says. "It is not going to happen. The process takes years, and this is as far as it goes."

Morgenthaler-Jones is more optimistic. She's counting on Schwarzenegger's high profile to draw attention to what she sees as a matter of individual rights, and she predicts an amendment will be ratified within six years, if not in time to qualify Schwarzenegger to run for president in 2008.

Restriction 'un-American'

The barrier to foreign-born citizens becoming president stems from fears that the Founding Fathers had during the Constitutional Convention of 1787. They were concerned that subversive enemies could force the fledgling republic back to foreign monarchical rule. Delegates didn't want the United States to suffer the same fate as Poland, which in 1772 had been partitioned among Austria, Prussia and Russia after agents of those countries bribed Polish nobles to elect a disloyal king.

The restriction on the foreign-born "has become an anachronism that is decidedly un-American," Hatch said during the hearing in October. Akhil Amar, a professor of constitutional law at Yale Law School, agrees: "Today, to worry about foreign dukes and earls, it's really a little paranoid."

But Sen. Dianne Feinstein, D-Calif., a Judiciary committee member, sees merit in the restriction. "I don't think it is unfair to say the president of the United States should be a native-born citizen," she said at the hearing. "Your allegiance is driven by your birth."

Polls aren't showing a national groundswell for putting a foreign-born citizen in the Oval Office. In a USA TODAY/CNN/Gallup Poll taken Nov. 19-21, 31% favored such an amendment, and 67% opposed it. Opposition dropped slightly, to 58%, when Schwarzenegger's name was included in the question.

Even among Republicans, the idea of an amendment hasn't taken hold. A Newsweek poll of 374 Republicans in September indicated that 30% would like to see Schwarzenegger run for president if the Constitution allowed it, while 57% said they wouldn't like it.

"Some people are talking as if a Manchurian Candidate could emerge and take over," says Rep. Dana Rohrabacher, R-Calif., referring to the Richard Condon novel and the two movies it inspired, in which communists brainwash an American to assassinate a presidential candidate.

Rohrabacher has introduced a House resolution that mirrors Hatch's proposal in the Senate. "Remember, the Manchurian Candidate was an American," Rohrabacher tells those who envision a foreign-born mole groomed for U.S. leadership.

If the question reaches the floor of Congress, "it would be very hard to vote against it without looking small or mean or bigoted," Amar says.

Supporters of an amendment often note that the Constitution disqualifies from top offices immigrants who have shown loyalty in positions of public trust. Henry Kissinger (who was born in Germany), Madeleine Albright (Czechoslovakia) and Christian Herter (France) were secretaries of State. Retired Army general John Shalikashvili, a former chairman of the Joint Chiefs of Staff, was born in Poland.

Schwarzenegger gets the attention, but others in high offices could benefit from what has become known on Capitol Hill as the "Arnold amendment."

Michigan Gov. Jennifer Granholm, a Democrat, was born in Canada. (When online surfers reach amendforarnold.org, the Web site's message is a bipartisan "amend for Arnold and Jen.") Sen.-elect Mel Martinez, R-Fla., was born in Cuba. Labor Secretary Elaine Chao is from Taiwan. Rep. Pete Hoekstra, R-Mich., chairman of the House Intelligence Committee, was born in the Netherlands.

So far, the most vocal opposition has come from people who simply don't like Schwarzenegger.

Alex Jones, an Austin-based host of a syndicated radio talk show, says he is a former Republican turned "libertarian and independent." His Web site, www.arnoldexposed.com, features negative stories about the celebrity governor that Californians heard during last year's recall campaign. They include allegations that Schwarzenegger sexually harassed women during his Hollywood days, and that his father was a Nazi.

"He's a bully and a preening peacock who is totally power-mad," Jones says. "For God's sake, don't let this megalomaniac become president."

Pleased but keeping distance

Morgenthaler-Jones says Schwarzenegger "made pleased noises" in August when she told him of her plans, and he gave her group a photo for its fundraising T-shirts.

In April, he said in a joking manner that he would run if the opportunity arose. At an international travel-industry show in Los Angeles, he said, "I thank you very much for changing the Constitution of the United States of America, and I accept your nomination to run for president." Pause. "Oh, wrong delegation. Sorry, wrong speech."

In some ways, Schwarzenegger already is "acting as if he wants to be president," the Los Angeles Times editorialized Nov. 20.

On a trade mission to Japan last month, Schwarzenegger had his picture taken with Prime Minister Junichiro Koizumi, who called him "more popular than Bush."

Schwarzenegger has visited King Abdullah II of Jordan and Israeli Prime Minister Ariel Sharon. He's planning visits next year to China and Europe. His square-jawed face is on billboards in a dozen cities from Florida to Seattle, touting California as a place to do business.

Lately, the governor has distanced himself from the presidential question. During a news conference in Sacramento on Nov. 3, he said, "This is a debate that people will have ... all over America, and I hope they leave me out of that debate. Otherwise, it becomes kind of a political debate between Democrats and Republicans."

He has a point. Matthew Spalding, director of the Center for American Studies at the conservative-oriented Heritage Foundation, says the amendment's prospects would "nosedive" if it were perceived to be designed to land Schwarzenegger in the Oval Office. "We don't amend the Constitution to advance someone's political career," Spalding says.

Schwarzenegger faces an additional handicap, Spalding says: "You can't have a United States president who is a dual citizen."

Proposals to end the Constitution's sole discrimination against the foreign-born have kicked around in Congress since the 1870s. But 26 proposed amendments have died in subcommittees.

In the new Congress, the Hatch-Rohrabacher amendment will compete with a bipartisan House resolution that would impose a 35-year citizenship requirement.

If that approach becomes law, Schwarzenegger would have to wait until 2020 to run for president. He'd be 73. A similar option: postponing an amendment's effective date for 10 years after it's ratified, essentially removing today's politicians from the equation.

"Let's take Arnold Schwarzenegger and Gov. Granholm off the table," Spalding says.

The highest barrier to an amendment could be a suspicion of foreigners that surveys suggest has deepened among Americans since the 9/11 terrorist attacks.

"Most Americans have an instinctive distrust of foreigners," says Forrest McDonald, a retired University of Alabama professor of American history, "and this has not changed appreciably in the last two, three, four years, since almost everyone in the world is against us on the Iraq thing."

Only Schwarzenegger's charisma has kept an amendment from being hooted down, says John Smolenski, an assistant professor of history at the University of California-Davis. "The idea that this would even be on the table is purely a testament to him."

If identifying an amendment with Schwarzenegger "helps it pass, that's fine with me," says Rep. Vic Snyder, D-Ark., a sponsor of the plan with the 35-year citizenship requirement. "But it's really about kids — kids now in kindergarten or grade school or junior high, getting their dreams lined up."

Moore continued by saying that he had no doubt that Schwarzenegger's controllers would get this done and that those in Hollywood who were concerned about what was happening better get serious and get serious now. He added that the American people know that Bush is a puppet and do not care and they would not have a problem with Schwarzenegger being a figurehead.

At this point, he indicated that branding was what would be important. He recommended a full mobilization and the enlistment of “beloved” individuals like Robert Redford, Paul Newman and others to potentially run for President against Arnold .

So now, top Hollywood Democrats are talking about Arnold for President being a done deal. This is ridiculous. The majority of Americans, the Founding Fathers and the Constitution are against the changes Schwarzenegger's people want to make. All we have to do is stand up and say “no!”

Whether you are a Republican who cares about your gun rights or a Democrat who is against wars for empire, you should be grabbing your torches and your pitchforks (figuratively) and be actively engaged in fighting against Arnold 's amend movement. For those who are still in denial, it is time for you to wake up to the fact that Schwarzenegger is already running for President.

Michael Moore then talked about Republican-funded ads running in film industry publications telling Academy members to vote against Michael Moore getting an Oscar for Fahrenheit 911. The general attitude in the room was that there needed to be counter-effort to make sure Moore would win the Oscar.

On Monday, the 29 th of November, former President H. W. Bush gave Arnold Schwarzenegger the George Bush Award at his Presidential library and told the crowd, "in regard to him ever being president of the United States , my advice to you Aggies and to any of those doubters, don't bet against Arnold Schwarzenegger.” Arnold responded by saying that he would like to see the Constitution amended so he could shoot for the top.

Even, USA Today and the Los Angeles Times had to admit that Arnold is basically already running for President and publicly pushing to have the Constitution amended. However, political strategists point out that if he publicly lobbies for himself personally people will say that amending the Constitution for just one man is ridiculous. By framing the debate in the context of “let's be fair to our 30 million immigrants,” Arnold and his gang may just be able to push the amendment through.

A similar amendment came within three states of passing just a few decades ago. Whether it's Congressman Dana Rohrabacher telling us that the Republican leadership wants Arnold in '08, or President Bush telling us to “do not doubt,” or “don't bet against” Arnold , the mantra is the same: resistance is futile, we're going to put a foreigner in the White House.

Americans Against Arnold supports the Constitutional provisions against any foreign-born citizen being able to run for President. Every other country has similar provisions – it is just common sense.

The cover story in the December 3rd issue of USA Today said that Americans Against Arnold has “raised allegations” that Arnold 's father was a Nazi. That is like saying the sun allegedly rises in the morning or that Arnold allegedly was born in Austria . We allege nothing. We state known fact. Arnold 's Nazi connections go a lot farther than his father. Everybody knows this.

An Article in TIME Magazine , titled, “ Arnold 's Groupies,” implies that the amend for Arnold movement is a spontaneous grassroots effort by out-of-work housewives. In reality, Amend for Arnold 's founder, Lissa Morgantheler-Jones was a founding member of Arnold 's campaign for governor and on the board of his fund-raising team.

Schwarzenegger has always said that he wants to amend the Constitution to run for President. His wife, Maria Shriver says she wants the Constitution changed, “but not for Arnold .” It cannot get any more transparent than this: While running a fulltime campaign against the Constitution, they deny the campaign has any connection to them to deflect criticism from the beneficiary, Arnold Schwarzenegger.

Whether you are a Republican or a Democrat, there are legions of reasons to be against amending the Constitution. The case against changing the Constitution only gets stronger when you cut through the spin and realize that all of this is for Arnold Schwarzenegger, an individual who constantly talks about how people need to be dominated and controlled, and who openly talks about his dreams of being a dictator.

What Americans should be most concerned about is the establishment media's complicity in spinning and whitewashing for Arnold Schwarzenegger who can only honestly be described as a bullying power-mad control-freak.

Bottom line: the establishment wants Arnold and the people do not. In the next three and a half years we can all look forward to space age public relations teams trying to cram Schwarzenegger down our throats. Please help Americans Against Arnold get the word out.
